Louisville Local Licensing Authority <br />Meeting Date: March 26, 2001 <br />4 <br /> <br />Chairperson Myers tabled item A. under Authority Business pending return of Deputy City Clerk Bolte to the <br />meeting. <br /> <br />Chairperson Myers called item C. under Authority Business. <br /> <br />C. New Application - Chipotle Mexican Grill, Inc., d/b/a Chipotle Mexican Grill - Hotel & <br /> Restaurant Liquor License - 375 S. McCaslin Blvd., Unit D. <br /> <br />Chairperson Myers moved to set the boundaries of the neighborhood as the' city limits of the City of Louisville <br />and that the public hearing date be set for April 30, 2001 at 7:00 p.m. in the 2"d floor Council Chambers of City <br />Hall, 749 Main Street, Louisville, Colorado. Member Jeffers seconded the motion. <br /> <br />Deputy City Clerk Bolte returned to the meeting. Chairperson Myers restated the motion and asked Bolte for a <br />roll call. Roll Call Vote: Sackett - yes, IGmmett - yes, Koertje - yes, Jeffers - yes, Myers - yes. All members <br />were in favor, motion carried. <br /> <br />Chairperson Myers called for the Authority to return to item A. under Authority Business, Final Decision and <br />Order for Bungalow Wine & Spirits. <br /> <br />Chairperson Myers read from the police report and Order to Show Cause for the March, 2000 violation by <br />Bungalow Wine & Spirits. The incident involved selling/serving a visibly intoxicated person and there was a <br />minor with the adult, but no alcohol was sold to the minor by the licensee. <br /> <br />Member Jeffers stated his preference and moved that the three days held in abeyance from the previous violation <br />be served and that five days be imposed for the current violation, with all five days to be held in abeyance. <br />Chairperson Myers stated he agreed with the penalty proposed by Member Jeffers. Myers stated that the licensee <br />had not been required to serve any suspension days for the previous violation and that now that a second <br />violation has been determined, the licensee should be required to serve the three days previously held in <br />abeyance. Myers continued that imposition of five days for this violation with all five held in abeyance is <br />appropriate for a second violation. Chairperson Myers seconded the motion. <br /> <br />Attorney Rennich approached the Authority and requested that the three days to be served be a Wednesday, <br />Thursday and Friday. Chairperson Myers stated his agreement with the days requested, stating that closing a <br />liquor store on a Friday and a Saturday would be a hardship. Members of the Authority voiced their agreement. <br /> <br />Chairperson Myers called for a roll call vote on the suspension days to be served. Roll Call Vote: KAmmett - yes, <br />Koertje - yes, Sackett - yes, Myers - yes, Jeffers - yes. All members were in favor, motion carried. <br /> <br />Chairperson Myers asked Attorney Rennich if Mr. Shin of Bungalow Wine & Spirits was prepared to state the <br />dates they would serve the suspension. Attorney Rennich stated that he would confer with the licensee, Mr. Lee <br />and advise Deputy City Clerk Bolte of the dates to be served. <br /> <br />Show Cause Hearing- Gentleman Jim's, Inc., d/b/a Gendeman Jim's Bar & Grill - Hotel & <br />Restaurant Liquor License - 330 S. McCaslin Blvd. <br /> <br />Chairperson Myers called the Show Cause Hearing to order and stated for the record that he is Bryan Myers, <br />Chairperson of the City of Louisville Local Licensing Authority.
