Louisville Local Licensing Authority <br />Meeting Date: March 26, 2001 <br />6 <br /> <br />Officer Muldoon, "yes." <br /> <br />Attorney Joss asked Officer Muldoon his name, occupation and length of employment. Officer Joe Muldoon <br />stated his name and that he was a Louisville Police Officer, and has been employed with the Louisville Police <br />Department for two years. <br /> <br />Attorney Joss asked Muldoon if he had any prior law enforcement experience and if so, when and where. <br />Muldoon stated he worked for the Garden City, Kansas Police Department for two and one half years, and then <br />for the Buena Vista Police Department for 4 and one half years. <br /> <br />Attorney Joss asked Muldoon if he had ever received training in recognition of intoxicated persons. Muldoon <br />stated he has received extensive training in the recognition of intoxicated persons. Mr. Joss asked Muldoon to <br />describe his experience. Muldoon stated that he received training in 1991 at the Police Academy and then in <br />1997 completed a drug recognition program sponsored by the DOT. Muldoon stated that he is a Drug <br />Recognition Expert and that he completed a field instructor program sponsored by the State of Colorado and <br />has been a Standard Field Sobriety Testing Instructor for one year. <br /> <br />Attorney Joss asked Muldoon the criteria for certification. Muldoon stated that certification requires eighty <br />hours of classroom work, individual certification on administering sobriety tests and successful evaluations of <br />intoxicated persons. <br /> <br />Attorney Joss asked Muldoon if he had received any additional training in DUI enforcement. Muldoon stated <br />that he has made approximately nine hundred DUI arrests in his seven years as a police officer and that he uses <br />the skills he's learned daily. <br /> <br />joss asked Officer Muldoon if has received any drug recognition training. Muldoon stated that the DRE <br />certification training includes recognition of intoxication and drug use. <br /> <br />Attorney Joss asked Officer Muldoon if he had ever testified in court as an expert witness and, if so, for which <br />courts. Muldoon stated that he has testified in Park County court on a DUI case in 1998 and also in Boulder <br />County court on two DUI cases during 2000. <br /> <br />joss asked Officer Muldoon if he was on duty January 13, 2001. Muldoon stated that he was. Attorney Joss <br />asked Muldoon if he responded to a report of a bicycle accident at the corner of McCaslin Blvd. and Cherry <br />Street on that date. Muldoon stated he did. Joss asked Muldoon if he recalled what time he arrived at the scene. <br />Muldoon stated it was approximately 12:50 p.m. <br /> <br />Attorney Joss asked Muldoon to describe his observations when he arrived on the scene. Muldoon stated that <br />he noticed cars in the westbound lane of Cherry and an individual, later identified as Chris Feeley, sitting on the <br />curb with a wound to his left cheek that was bleeding badly. <br /> <br />Attorney Joss asked Muldoon if Mr. Feeley indicated how he obtained the injury. Muldoon stated that Feeley <br />told him he had fallen off his bicycle. Joss asked Muldoon the weather conditions on that day. Muldoon stated <br />that the weather was clear and cool. <br /> <br />joss asked Muldoon to describe the injuries he observed on Mr. Feeley. Muldoon stated he had a tear to his left <br />cheek that was bleeding badly. He noticed no other injuries. Joss asked Muldoon to describe the appearance <br />and behavior of Mr. Feeley.
