Louisville Local Licensing Authority <br />Meeting Date: May 14, 2001 <br />2 <br />VI. AUTHORITY BUSINESS <br /> <br />A0 <br /> <br />Show Cause Hearing - Holly & Mike's Ribs, Inc., d/b/a Hickory Sticks Smokehouse & Grill <br />- Hotel & Restaurant Liquor License - 1000 S. Boulder Road. <br /> <br />Chairperson Myers stated that the purpose of the hearing is to receive testimony and evidence in mitigation <br />and aggravation by the City and Licensee. The Licensee has confessed to violation of the laws, set forth in <br />the State of Colorado statutes, Colorado Liquor Code regulations and/or City of Louisville ordinances. <br /> <br />Attorney Harrington stated that a draft of the Findings was included in the Authority packets. Harrington <br />stated that the Authority should review the Findings of Fact, Conclusions of Law and Order to ensure they <br />represent the agreement reached by both parties at the April 30, 2001 meeting, and that, if acceptable, a <br />motion be made to approve the Findings. <br /> <br />Harrington noted an error on page 5, which states "the period of the sixteen day suspension" and stated that <br />this section should be blank. <br /> <br />Chairperson Myers asked members if they had any changes to the Findings of Fact, Conclusions of Law or <br />Order. None stated. <br /> <br />Vice Chairperson Lipton asked if there would be any discussion on the Stipulation. Attorney Harrington <br />stated that Stipulation was presented at the last meeting and that these findings are intended to reflect the <br />agreement reached by both parties. Once a motion is made and the findings are approved, the Authority <br />may then consider the testimony presented this evening and determine an appropriate penalty. <br /> <br />Attorney Steven Barnett, counsel for the City, greeted the Authority and asked if he could comment on the <br />proposed findings. Barnett stated that the Licensee admitted to certain facts but that no conclusions of law <br />were discussed at the April 30, 2001 hearing. <br /> <br />Authority Attorney Harrington stated that it was her understanding that the licensee confessed to all of the <br />violations as contained in the Show Cause Order and asked if that was correct. <br /> <br />Attorney for the Licensee, Kevin Moore, stated that he did not agree. Moore stated that his clients did agree <br />that violations occurred, but that his clients did not admit to all of the violations alleged in the Order. <br /> <br />Attorney Moore stated that he did not feel the Authority had been given all of the facts, and that the <br />evidence and testimony given this evening would clear his clients of some of the allegations. <br /> <br />Attorney Harrington stated her understanding that City Attorney Sam Light circulated a draft of the <br />Findings of Fact, Conclusions of Law and Order to Attorney Moore and to Attorney Barnett for review and <br />comments, and stated that Attorney Moore did not respond in any way. Moore stated he did receive the <br />draft, but felt that since he was only carbon copied on the document, he did not have the right to amend the <br />findings of the Authority. <br /> <br />Attorney Harrington said she was reviewing the minutes from the April 30, 2001 meeting to determine the <br />agreement reached by both parties.
