RESOLUTION NO. <br />SERIES 2020 <br />A RESOLUTION APPROVING AN ALLOTMENT CONTRACT BETWEEN THE <br />WINDY GAP FIRMING PROJECT WATER ACTIVITY ENTERPRISE, MUNICIPAL <br />SUBDISTRICT, NORTHERN COLORADO WATER CONSERVANCY DISTRICT, <br />AND THE CITY OF LOUISVILLE, A COLORADO HOME RULE MUNICIPAL <br />CORPORATION, ACTING BY AND THROUGH THE CITY OF LOUISVILLE WATER <br />ACTIVITY ENTERPRISE, FOR CAPACITY IN THE WINDY GAP FIRMING <br />PROJECT <br />WHEREAS, an Allotment Contract ("Allotment Contract") between the Windy Gap <br />Firming Project Water Activity Enterprise ("WGF Enterprise"), Municipal Subdistrict, Northern <br />Colorado Water Conservancy District, and the City of Louisville ("City"), acting by and through the <br />City of Louisville Water Activity Enterprise, has been proposed for the City's allotment of capacity <br />in the Windy Gap Firming Project, and the City Council desires to approve such Allotment <br />Contract and authorize its execution. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1. The proposed Allotment Contract ("Allotment Contract") between the Windy Gap <br />Firming Project Water Activity Enterprise ("WGF Enterprise"), Municipal Subdistrict, Northern <br />Colorado Water Conservancy District, and the City of Louisville ("City"), acting by and though the <br />City of Louisville Water Activity Enterprise, for the City's allotment of capacity in the Windy Gap <br />Firming Project, is hereby approved in essentially the same form as the copy of such Allotment <br />Contract accompanying this Resolution. <br />2. The Mayor is authorized to execute such Allotment Contract, except that the Mayor <br />is hereby granted the authority to negotiate and approve such revisions to said Allotment Contract as <br />the Mayor determines are necessary or desirable for the protection of the City, so long as the <br />essential terms and conditions of the Allotment Contract are not altered. <br />3. The Mayor, City Manager and City Staff are further authorized to do all things <br />necessary on behalf of the City to perform the obligations of the City under such Allotment <br />Contract. <br />PASSED AND ADOPTED this day of , 2020. <br />Ashley Stolzmann, Mayor <br />ATTEST: <br />14 <br />
