Prairie dog shall have the same meaning as the term "Prairie Dog," as defined in Section <br />25-2. <br />Sec. 25-120. Permit Required. <br />(a) Except as otherwise specifically permitted under this Article, the control <br />of prairie dogs located on property within the City requires a prairie dog control permit <br />issued by the Director, in addition to any applicable permit under any Colorado <br />Division of Wildlife or Department of Agriculture permitting processes relating to the <br />control of prairie dogs. <br />(b) Notwithstanding subsection (a) of this section, the Director may issue, in <br />writing, a special permit to a person authorizing the control of prairie dogs located on <br />property within the City in conformity with Section 25-122. <br />(c) Except as otherwise specifically permitted under this Article, it shall be <br />unlawful for any person to control, or perform any control activity on, a prairie dog <br />located on property within the city, without a special permit or prairie dog control <br />permit issued under authority of the Director, or in a manner contrary to the terms and <br />conditions set out in such permit. <br />(d) No permit shall be issued pursuant to this Article between March 1 <br />through June 1. <br />(e) The prairie dog control permit issued pursuant to this Article shall only <br />authorize the permittee to use carbon monoxide as a means of lethal control of prairie <br />dogs. <br />Sec.25-121. Exemptions. <br />A prairie dog control permit under Section 25-120 shall not be required for the <br />following: <br />(a) Acts by a person who owns or operates an airport facility, or by a person <br />acting at the direction of the owner or operator of an airport facility, which are necessary <br />to promote human safety or to comply with Federal Aviation Administration standards or <br />regulations. <br />(b) Acts by a person who owns or operates a dam or irrigation ditch, where <br />the structural integrity or the safety thereof is threatened by prairie dog burrows or <br />burrowing. <br />(c) Public or utility -related construction projects conducted in conformity <br />with the city's prairie dog management policy. <br />(d) Acts by public law enforcement personnel, including animal control <br />officers, for the purposes of carrying out their official duties. <br />3 <br />
