Louisville Local Licensing Authority <br />Meeting Date: July 30, 2001 <br /> <br />the arresting officer to see if there were any addition reports or information on this incident, if the <br />Authority so desired. <br /> <br />Member Kimmett stated that the question of whether the individual was intoxicated upon entering <br />Henry's, or whether he became intoxicated while at the establishment, was still of concern to him. <br /> <br />Riggins stated that the average person metabolizes one ounce per hour, and that being there for four <br />hours would mean the person would have to had to consume ten to twelve drinks to reach the BAC <br />level of .264. <br /> <br />Member Sackett asked Attorney Harrington how the Authority could handle a situation in which <br />they suspect an employee of the licensee is not telling the truth. Attorney Harrington stated that the <br />Authority may order a show cause hearing on the matter to determine if violations by the licensee <br />were committed based on the possible conflicting testimony, but that direct action could not be <br />taken against an individual employee. <br /> <br />Sergeant Riggins stated that he and Officer Gordanier conducted a complete liquor training session <br />for all the employees of Henry's Bar & Grill at the request of the Authority earlier this year. Vice <br />Chairperson Koertje asked if the bartender on duty attended the training session. Riggins stated that <br />she had. <br /> <br />Sergeant Riggins stated that based on his previous experience, the special prosecutors utilized by the <br />Authority would not want to prosecute this case. Riggins stated he would follow up to see if there <br />are any additional details, should the Authority desire. <br /> <br />Vice Chairperson Koertje stated his opinion that he would like to have Sergeant Riggins follow up at <br />the next meeting. <br /> <br />Member Sackett moved to table the May 26, 2001 incident report for Henry's Bar & Grill to the <br />next regularly scheduled meeting August 27, 2001. Member Khmmett seconded the motion. Roll <br />Call Vote: Kimmett - yes, Koertje - yes, Sackett - yes. All members were in favor, motion carried. <br /> <br />B. Incident Report - Romero's Liquors <br /> <br />Sergeant Riggins summarized an incident that occurred June 29, 2001 alleging the sale of alcoholic <br />beverages to an under aged person. <br /> <br />Authority Attorney Harrington stated that, should the Authority order a Show Cause hearing on this <br />matter, Special Prosecutor Bruce Joss would be in favor of including this order with the two <br />previous orders issued and scheduled to be heard on August 27, 2001. The Authority would be <br />required to make a motion to amend the previous Show Cause Order to include this latest incident. <br /> <br />Member Sackett moved to amend the order for a Show Cause hearing drafted for the March 24, <br />2001 and April 27, 2001 incident and ordered May 21, 2001 to include the June 29, 2001 incident <br />ordered at this meeting, finding probable cause to believe that the Licensee committed one or more <br />violations of the following; C.R.S. [ 12-47-901 (1)(a), which provides that it is unlawful for any <br />person to sell, serve, give away, dispose of, exchange, or deliver or permit the sale, serving, giving, or <br />procuring of alcoholic beverages to or for any person under the age of twenty-one years; C.R.S.
