Louisville Local Licensing Authority <br />Meeting Date: August 27, 2001 <br /> <br />alleged violations of one or more provisions of the Colorado Liquor Code and Liquor Code <br />Regulations in the Louisville Municipal Code. <br /> <br />She continued that the purpose of this hearing is to receive evidence to enable the Authority to <br />make findings and reach a conclusion as to whether there is sufficient evidence proving the Licensee <br />violated one or more of the laws and regulations set forth in the Show Cause Order and if so, <br />whether revocation or suspension of the Licensee's license is appropriate. <br /> <br />Chairperson Lipton stated that the order of the hearing would be, a.) Opening Statements by the <br />City and the Licensee, b.) Presentation of evidence by the City, followed by cross examination by the <br />Licensee, c.) Presentation of evidence by the Licensee, followed by cross examination by the City, d.) <br />Rebuttal Evidence by the City and Licensee, if any, and e.) Closing statements by the City and the <br />Licensee. <br /> <br />Chairperson LiptOn stated that the hearing was being recorded. Anyone wishing to address the <br />Authority must speak clearly into the microphone and identify himself or herself by name and <br />address. All testimony will be given under oath. Exhibits will be first marked by the Secretary and <br />then identified before offering them for admission. A record will be kept of exhibits admitted and <br />rejected. <br /> <br />Lipton asked the attorneys for the City and Licensee please identify themselves and state whether <br />they are ready to proceed. <br /> <br />Prosecuting Attorney Shapiro and Attorney for the Licensee J. Y. Kang greeted the Authority. <br /> <br />Chairperson Lipton asked if either party had any preliminary matters to be taken care of at this time. <br /> <br />Attorney Kang stated that he wished to formally request a continuance of this matter on behalf of <br />the Licensee. Kang stated that this incident involves the sale of alcohol to a minor and is contingent <br />upon the credibility of one witness, Patrick Kage. Mr. Kage is the person who allegedly purchased <br />the liquor on the date in question and has been contacted by a person present at the hearing and <br />admitted to that person that he has presented fraudulent ID in the past to the clerks of the Licensee, <br />Bungalow Wine & Spirits. Attorney Kang stated that Mr. Kage stated he would cooperate, however <br />he is going to Haxvaii for two weeks and would not return until just prior to the hearing. Kang <br />stated that he has tried to contact Mr. Kage within the last week and that his home phone has been <br />disconnected, and that persons at his workplace state he no longer work there. Attorney Kang <br />stated he has discussed this matter with Attorney Shapiro on Friday and that Attorney Shapiro has <br />also been unable to serve Mr. Kage with a subpoena. <br /> <br />Attorney Kang stated that he is r~questing the Authority grant a continuance based on the detail <br />stated and that additionally, he feels that a stipulated agreement could be reached between himself <br />and Attorney Shapiro. Kang also stated that the Licensee has intentions to sell the business. <br /> <br />Attorney Shapiro confirmed that had tried to serve a subpoena on Mr. Kage through the Louisville <br />Police Department and was unable to do so.
