Louisville Local Licensing Authority <br />Meeting Date: August 27, 2001 <br /> <br />Vice Chairperson Koertje asked if the video-tape from the establishment for the date of the alleged <br />violation had been obtained. Attorney Shapiro stated that this being the third time such tape would <br />have been requested, and that previously no tape had been made available, he did not request the <br />video-tape. <br /> <br />Attorney Harrington stated that a Subpoena to Produce was issued to Mr. Chan Soo Lee. <br /> <br />Attorney Kang stated that his client did not inform him of the Subpoena to Produce. Kang stated <br />that no one is necessarily alleging that Mr. Kage presented false identification on the date in <br />question, but rather that on five or six previous occasions, Mr. Kage had shown the clerk a fake ID. <br /> <br />Attorney I~ang stated that Mr. Kage was an employee of Miller and that he would routinely go into <br />Bungalow Wine & Spirits to set up displays and make deliveries. Kang also stated that the <br />subsequent driver for Miller allegedly stated to other persons that the reason Mr. Kage was fired was <br />because he had used fraudulent identification to obtain the job. <br /> <br />Member Jeffers stated that the request for a continuance seemed reasonable considering the <br />circumstances surrounding this incident. <br /> <br />Chairperson Lipton stated that the next regular meeting of the Authority is September 17th and <br />asked Attorney Shapiro and Kang if that would be enough time to track down Mr. Kage and have <br />him present to testify. <br /> <br />Both attorneys stated that they would prefer to continue the matter to the October 29, 2001 meeting <br />of the Local Licensing Authority. <br /> <br />Chairperson Lipton moved to continue the Show Cause Hearing for Bungalow Liquors, Inc., d/b/a <br />Bungalow Wine & Spirits to the October 29, 2001 regular meeting of the Louisville Local Licensing <br />Authority. Member Kimmett seconded the motion. Roll Call Vote: Koertje - no, Sackett - yes, <br />Jeffers - yes, Lipton - yes, Kimmett - yes. By a vote of 4-1, motion carried. <br /> <br />Authority Attorney Harrington asked to speak to the Authority and apologized for not mentioning a <br />matter previously. Hamngton stated that Prosecuting Attorney Steve Barnett wished to address the <br />Authority on a Show Cause Hearing he is working on. <br /> <br />Chairperson Lipton moved to add the report of Attorney Steve Barnett to the Agenda. All <br />members were in favor, motion carried. <br /> <br />C. Update on Show Cause Hearing - Celtic Way Ltd, d/b/a Druids Arms <br /> <br />Attorney Barnett greeted the Authority and stated he wished to address the Authority on the matter <br />of the Show Cause hearing for Druids Arms scheduled for the September 17, 2001 regular meeting <br />of the Authority° <br /> <br />Barnett stated that the alleged incident occurred in March 2001, and that based on his investigation, <br />is requesting the charges be dismissed. Attorney Barnett stated that the incident alleged the sale of <br />alcohol to a visibly intoxicated person.
