The LMC sets <br />forth the following for the CC -MU zone district. <br />Commercial Community (— Mixed Use) zone district is intended to provide <br />zoning which would encourage the development of a limited range of highway <br />oriented commercial uses adjacent to Highway 42. The commercial community <br />zoning is intended to address the market demand for highway -oriented <br />commercial development in a form that would protect the existing residential <br />neighborhoods as well as interface effectively with the future mixed use <br />development of the neighborhood. <br />The subject property is currently zoned CB and was approved for development of an <br />auto body repair shop through a Planned Unit Development and Special Review Use in <br />2005. The property is comprised of two lots, but developed as a single property with <br />improvements spanning the property line separating the two lots. In 2007, the property <br />owner executed a covenant and agreement to hold the two lots as a single parcel. <br />In 2019, the City of Louisville amended the LMC related to marijuana sales, which <br />reduced and removed certain buffers and increased the number of available locations <br />within the City. The applicant was recently approved for a license for retail marijuana <br />sales at this location.
