Louisville Local Licensing Authority <br />Meedng Date: September 17, 2001 <br /> <br />history records for Mr. Lorenzi and Mr. Ross would be forwarded to the Liquor Enforcement <br />Division for their records. <br /> <br />POLICE DEPARTMENT REPORT <br /> <br />A. Incident Report - Pine Street Junction <br /> <br />Sergeant Riggins summarized the details of an incident that occurred August 17, 2001 at Pine Street <br />Junction. Riggins stated that the incident was not reported by the establishment as required by law. <br /> <br />Sergeant Riggins stated that the results of interviews conducted by Officer Gordanier were <br />contained in the supplemental report. Riggins stated that the supplemental report contains probable <br />cause to indicate that persons were served that were visibly intoxicated. Riggins also stated that <br />summonses were issued for failure to report the incident and selling/serving to certain persons <br />prohibited. <br /> <br />Sergeant Riggins stated this was the most extensive investigation of a liquor violation that he had <br />seen in ten years. Riggins stated he ~vas available for Authority questions. <br /> <br />Chairperson Lipton asked if all the witnesses would be available to testify. Riggins stated that the <br />Authority could issue subpoenas any or all of the parties involved. <br /> <br />Chairperson Lipton called for member discussion and comments. <br /> <br />Member Kimmett concurred with Sergeant Riggins' statement that the investigation and report was <br />very thorough and extensive. Kimmett stated he believed there was sufficient evidence to order a <br />hearing. <br /> <br />Sergeant Rig, gins stated that the part of the report that concerned the Police Department the most <br />was not only the failure to report the incident, but also the apparendy deliberate attempt to move <br />the situation elsewhere and deny that the incident ever took place. <br /> <br />Member Sackett asked if there was already a hearing scheduled for Pine Street Junction. Attorney <br />Harrington stated that there was a Show Cause hearing scheduled for this evening on a separate <br />violation. Harrington stated that contained under the Secretary's Report is a copy of a request for <br />continuance by the licensee's attorney and an order granting the continuance, which was issued by <br />Deputy City Clerk Bolte. Attorney Harrington stated that the attorney for the licensee became <br />aware of the latest incident and requested that both matters be addressed at the October 29, 2001 <br />meeting. <br /> <br />Attorney Harrington stated that, in the past, the Authority has amended Show Cause Orders to <br />include subsequent incidents and had the amended order served on the licensee. <br /> <br />Member Jeffers questioned whether the incidents should be addressed together or back-to-back. <br />Jeffers stated his concerns, noting that if the statements contained in the police reports are credible, <br />he has serious concerns about how the establishment is being operated. <br /> <br />Member Sackett stated that she would prefer to have two separate hearings held back-to-back, rather <br /> <br /> 3 <br />~\FRED~VAPd~AN\LIQU OR~2001 \MINUTES\MINUTES09170I.DOC <br /> <br /> <br />
