RESOLUTION NO.87 <br />SERIES 2020 <br />A RESOLUTION APPROVING A FIRST AMENDMENT TO AND ASSIGNMENT OF <br />PARKING LEASE AGREEMENT <br />WHEREAS, the City leases parking spaces on property it owns to Lucky Pie, a restaurant <br />operating in downtown Louisville; and <br />WHEREAS, in consideration of the negative economic impacts on its restaurant by COVID- <br />19, Lucky Pie has requested the City reduce the rental payments required by the Lease Agreement for <br />2020; and <br />WHEREAS, additionally, the parties desire to assign the Lease Agreement to the entity <br />currently operating the restaurant. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The First Amendment to and Assignment of Parking Lease Agreement, a copy <br />of which accompanies this Resolution, is hereby approved. <br />Section 2. The Mayor and City Clerk are hereby authorized to execute the First <br />Amendment and Assignment, and the Mayor is hereby further authorized to negotiate and approve <br />such revisions to the First Amendment and Assignment as the Mayor determines are necessary or <br />desirable for the protection of the City, so long as the essential terms and conditions of the First <br />Amendment and Assignment are not altered. <br />PASSED AND ADOPTED this 2nd day of November, 2020. <br />Ashley S z ann, Mayor <br />ATTEST: <br />Meredyth Muth, City Clerk <br />SEAL <br />Resolution No. 87, Series 2020 <br />Page 1 of 1 <br />
