RESOLUTION N0.9 <br />SERIES 2009 <br />A RESOLUTION APPROVING A REQUEST FOR .~ SPECIAL REVIEW USE (SRU) <br />PERMIT TO ALLOW FOR THE PLACEMENT OF AN ALTERNATIVE TOWER <br />STRUCTURE (ATS) CMRS FACILITY ON PROPERTY OWNED BY <br />CONOCOPHILLIPS. <br />WHEREAS, there has been submitted to the Louiisville City Council, a request for <br />approval of a Special Review Use (SRU) to allow for the placement of an Alternative Tower <br />Structure (ATS) CMRS facility on property owned by ConocoPhillips; and <br />WHEREAS, all materials related to the a Special Review Use have been reviewed by <br />City Staff and the Planning Commission and found, to be in compliance with the Louisville <br />zoning ordinances, the Commercial Development Design Standards and Guidelines, related <br />policies and previous approvals; and <br />WHEREAS, after a duly noticed public hearing concerning said Special Review Use <br />on February 12, 2009, where evidence and testimony were entered into the public record, <br />including the staff report dated February 12, 2009, the Planning Commission recommended <br />approval to the City Council, with the following conditions: <br />1. The proposed ATS shall be designed as a monopole painted to match the cortan of <br />existing Excel transmission poles. <br />2. The Special Review Use is granted to the applicant only; and <br />WHEREAS, City Council has reviewed the application, including the recommendation <br />of the Planning Commission and that the application should be approved, with the following <br />conditions: <br />1. The proposed ATS shall be designed as a monopole painted to match the cortan of <br />existing Excel transmission poles. <br />2. The Special Review Use is granted to the applicant only. <br />3. This Special Review Use approval shall expire March 3, 2014; and <br />NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Louisville, <br />Colorado does hereby approve a Special Review Use (SR~U) to allow for the placement of an <br />Alternative Tower Structure (ATS) CMRS facility on property owned by ConocoPhillips, with <br />the above three conditions. <br />F ~-Q ah• AND ADOPTED this 3`d day of Mar h, 9. <br />.~ <br />BY: <br />S E~ ~~ rles .
