Louisville Local Licensing Authority <br />Meeting Date: November 19, 2001 <br /> <br />Restaurant Liquor License - 700 Main Street. <br /> <br />Authority Chairperson Lipton stated that this hearing is to determine whether to permit the transfer <br />of ownership of the Hotel and Restaurant liquor license held by Four Top, Inc., d/b/a Karen's <br />Country IWdtchen to KC Kitchen, Inc., d/b/a ICaren's Country Kitchen. <br /> <br />Lipton stated that the purpose of the hearing is to receive evidence to enable the Authority to <br />determine: (1) whether the Applicant has demonstrated it has legal possession of the premises for <br />the one-year period of the license; (2) whether the Applicant or any of its shareholders have made <br />material misrepresentations or false statements on the transfer application, including the Individual <br />History Records supplied with the application; and 0) whether the Applicant is prohibited from <br />holding a liquor license by C.R.S. [ 12-47-307(1)(a), which provides in pertinent part that no liquor <br />license shall be issued to or held by any person who is not of good moral character or any <br />corporation, any of whose officers, directors, or stockholders holding ten percent or more of the <br />outstanding and issued capital stock thereof are not of good moral character. <br /> <br />Chairperson Lipton stated that the order of the hearing would be as follows: (a) Opening Statements <br />by the City and the Licensee, 0o) Presentation of evidence by the City, followed by cross <br />examination by the Licensee, (c) Presentation of evidence by the Licensee, followed by cross <br />examination by the City, (d) Rebuttal Evidence by the City and Licensee, if any, and (e) Closing <br />statements by the City and the Licensee. <br /> <br />Authority Chairperson Lipton stated that the hearing was being recorded and that anyone wishing to <br />address the Authority must speak clearly into the microphone and identify himself or herself by <br />name and address. Lipton stated that all testimony would be given under oath. Exhibits will first be <br />marked by the Secretary and then identified before offering them for admission. A record will be <br />kept of exhibits admitted and rejected. <br /> <br />Lipton called for the attorneys for the City and Licensee to come forward, identify themselves and <br />state whether they were ready to proceed. <br /> <br />City Prosecuting Attorney Steve Barnett stated he was ready to proceed. Attorney for the Applicant, <br />Cliff Carney stated he was also ready to proceed. <br /> <br />Authority Chairperson Lipton asked if either party had any preliminary matters to be taken care of. <br />Both attorneys stated they did not. <br /> <br />Chairperson Lipton stated that the Notice of Hearing on the Application for Transfer of the Liquor <br />License and the Application for Transfer filed by the Applicant, including the supporting <br />documentation contained in the member packets will be made a part of the record of the heating, <br />and asked if there was any objections. Attorneys Barnett and Carney stated they had no objections. <br /> <br />Authority Chairperson Lipton called for Opening Statements. <br /> <br />Prosecuting Attorney Barnett greeted the Authority and stated that his participation at the hearing is <br />limited to the investigation of factual matters concerning the completeness of the application, and <br />that he did not review the transfer application as a whole.
