Louisville Local Licensing Authority <br />Meeting Date: November 19, 2001 <br /> <br />Member KJmmett asked Attorney Barnett how he interprets Question #22 on the Individual <br />History Record. Attorney Barnett stated that he felt the form utilized a poor choice of words. <br />Barnett stated his opinion that the phrase "driving under the influence" does not single out DUI's, <br />and that DWAI's are also alcohol related driving violations. <br /> <br />Authority Chairperson Lipton called for presentation by the Applicant. <br /> <br />Attorney Carney stated, based on his review of statute 12-47-307(1)(a), that driving while ability <br />impaired is not considered an offense that relates to moral character. <br /> <br />Attorney Carney asked Mr. Bickler to state his name and address, Mark Allen Bickler, 32863 Upper <br />Bear Creek Road, Evergreen. <br /> <br />Carney asked Mr. Bictder's age and whether he had a family. Mr. Biclder stated he was 41 and has a <br />wife and five children, ages 15, 13, 11 and twins. <br /> <br />Carney asked Mr. Biclder his profession. Mr. Bickler stated he owned two restaurants and Boulder <br />Dairy. <br /> <br />Carney asked Mr. Bic!der if he had recently purchased Karen's Country Kitchen, and to describe the <br />establishment. Mr. Bickler stated he had purchased the establishment and that it is a breakfast and <br />lunch restaurant that also offers fresh baked goods. Bickler stated that the restaurant is located in a <br />historic building in downtown Louisville and that it has been there for approximately 25 years. <br /> <br />Attorney Carney asked Mr. Bickler how he came to know of Karen's and that it was for sale. Mr. <br />Biclder stated that he used to make deliveries to Karen's for Boulder Dairy and that he had <br />purchased his wedding cake there. <br /> <br />Attorney Carney asked Mr. Bickler about the liquor license and the importance of the license to the <br />business. Mr. Bickler stated that alcohol sales account for a very small part of their business and that <br />the main consumption is Bloody Marys and Mimosas at Sunday Brunch. Bickler stated that they <br />would like to keep the license intact. <br /> <br />Carney asked Mr. Bickler if he had ever held a liquor license in the past, and if so, where. Mr. <br />Bickler stated that he had held a retail liquor store license for Bergen Park Wine Cellar in Evergreen. <br /> <br />Attorney Carney asked Mr. Bickler if the liquor store license had ever been suspended or revoked. <br />Mr. Bickler stated it had not. <br /> <br />Attorney Carney asked Mr. Biclder if he understood that the Deferred Sentence he was given for the <br />"possession" charge included an admission of guilt. Mr. Bickler stated he did not. <br /> <br />Attorney Carney submitted two documents, Motion to Dismiss dated September 7, 2000 and <br />Amended Information and Complaint dated February 27, 2000, to the Authority and requested they <br />be admitted as evidence. Attorney Light stated that the three pages would be admitted as <br />"Applicant Exhibit A." Chairperson Lipton asked if there were any objections.
