Boulder County, CO 03715259 5 of 62 <br />completed in compliance with the Plan (as evidenced by a writing issued by the Planning <br />Department). <br />Prior to Construction Acceptance of the Subdivider Improvements, Subdivider may <br />request reduction in the Improvement Guarantee for any portion of the Subdivider <br />Improvements that (i) have boon completed and (ii) constitute a distinct system (e.g. water or <br />sewer lines) or otherwise are reasonably ready to be placed into service independently (e.g. <br />roadways in a particular_ area), as determined by the City. Such requests shall be made by <br />written notice from Subdivider to the City, accompanied by a certified statement of <br />construction costs for such Subdivider Improvements. If such Subdivider Improvements are <br />satisfactory, as determined by the City, then the City shall reduce the Improvement <br />Guarantee by 85% of the estimated cost of such Subdivider Improvements that are <br />determined satisfactory, such 85% amount to be determined by the City by reference to <br />Exhibit A. Such reductions in the Improvement Guarantee shall not constitute Construction <br />Acceptance. Correction of any unsatisfactory conditions shall be handled as provided above. <br />1.7 Maintenance, Repair, and Replacement of Improvements. For a two (2) year <br />period from the date of Construction Acceptance of the Subdivider Improvements, <br />Subdivider shall, at its own expense, take or cause its contractor(s) to take all actions <br />reasonable and necessary to maintain said Subdivider Improvements and make all needed <br />repairs or replacements which, in the reasonable opinion of the City, shall become necessary <br />to obtain Final Acceptance of such Subdivider Improvements. If within thirty (30) days after <br />Subdivider's receipt of written notice from the City requesting such maintenance, repairs or <br />replacements, Subdivider has not completed such maintenance, repairs or replacements, then <br />(30) days after Subdivider's receipt of written notice from the City, the City may exercise its <br />rights to secure performance as provided in Section 9.1 of this Agreement. The City shall <br />have no maintenance obligations with respect to the Subdivider hmprovements. <br />Notwithstanding anything to the contrary within this Agreement, maintenance after Final <br />Acceptance shall be allocated between the Subdivider and the City in accordance with <br />5 <br />
