Susan Griffiths, City Attorney, agreed.

Davidson wanted this as an added condition on the agreement.

Sisk moved that Council approve the license agreement with the amendment that this license
agreement be recorded before the Deed of Trust is recorded, seconded by Howard.

Lathrop questioned the error and did not want this to be a habit.

Lathrop offered a friendly amendment that the applicant for this license agreement follow through to
vacate a portion of that easement within the next six months.

Sisk and seconder Howard accepted that. All in favor.

CITY ADMINISTRATOR'S REVIEW

Davidson summarized that the City Administrator's currant salary is $73,186/year. The mean salary
of 10 comparison cities is $81,290/year for the same position. Council rated the Administrator at
7.75, with 10 being the highest. Council recommended as salary adjustment of 3.5% and a merit
increase of 5.36%. After this adjustment, the City Administrator's salary would be $79,671/year
retroactive to January 1, the date the contract was put in place. Other changes to the contract would
be to increase deferred compensation from 1.5% to 3%.

Mayer moved that Council authorize these changes to the City Administrator's contract and authorize
the mayor to sign the contract, seconded by Levihn.

Davidson also interviewed each of the department heads in the City and was pleased with their
comments on the City Administrator and his management style.

Roll call was taken. Motion passed by a 7 - 0 vote.

OTHER REGULAR BUSINESS ITEMS ARISING AFTER PREPARATION OF AGENDA
NONE

CITY ATTORNEY'S REPORT

NONE

9
