<br />Louisville Local Licensing Authority <br />Meeting Date: April 26, 2004 <br />Page 4 of 6 <br /> <br />Member Mulvahill felt the stipulation was appropriate and thought the circumstance <br />called for a nominal amount that sends a message but does not cripple the DBA. He <br />asked if Mr. McCarthy's license at the Old Louisville Inn could be looked at with him <br />serving as manager for the Special Event Permit. Attorney Light felt the hiring of a <br />licensed owner of an establishment as a Special Event Manager was permissible and <br />that seeking disciplinary action against one in response to violation of the other would <br />not be warranted. <br /> <br />Member Lipton asked about holding one of the special event permits over the summer <br />in abeyance as punishment. Attorney Light thought disciplinary action in that manner <br />might be difficult to administer. <br /> <br />Mr. Lehman wanted to express that the message was definitely received by the DBA <br />that this was a serious situation and there has been a tremendous financial impact. <br /> <br />Discussion centered on how to impose penalty. There was discussion about finding out <br />what other jurisdictions had done with similar situations. The consensus was there <br />were probably not many to compare just by nature of this permit. Chairman Koertje <br />stated he would like to see the matter settled at this meeting. There were questions <br />above imposing a fine with a portion suspended with Attorney Light answering that the <br />administration would be difficult. <br /> <br />Mulvahill moved the Authority approve the proposed Stipulation indicating that the fine <br />imposed be $50.00. Rommelfanger seconded. Koertje-yes, Mulvahill-yes, Lipton-no, <br />Wilson-yes and Rommelfanger-yes. <br /> <br />Wilson moved the Authority adopt the Findings as set forth in the Stipulation and order <br />the disciplinary actions set forth in the Stipulation be imposed. Mulvahill seconded. <br />Koertje-yes, Mulvahill-yes, Lipton-no, Wilson-yes and Rommelfanger-yes. <br /> <br />Koertje thanked Mr. Shapiro and the members of the Downtown Business Association. <br /> <br />C. Special Events Permit - Downtown Business Association - Summer Street <br />Faire - Steinbaugh Pavilion <br /> <br />Mr. Lehman of the Downtown Business Association expressed his excitement about the <br />continuing of the Summer Street Faire and reminded the Authority of the proactive <br />things they have done. A question was asked about storage of the liquor. New Belgium <br />Brewery is bringing in a truck and kegs will remain on the truck and only be removed for <br />serving. He talked of controlling the premises with chained off areas and manning the <br />entrances with volunteers as well as hiring off-duty officers. Detective Lanphere <br />commented the DBA has done a lot of planning to make this a safe and family friendly <br />event.
