Louisville Local Licensing Authority
Meeting Date: July 26, 2004

experience in the retail liquor business. Ms. Kidane stated she is the sole operator of
the store at this point. Questions were asked about the former owners and whether Ms.
Kidane had any dealings with them. The answer was no. Discussion centered on the
previous inventory being auctioned off, sales tax issues and the previous owner being
evicted. A question was raised about sales tax being owed to the city. Secretary
Hanson reported there is no sales tax due to the city.

Mulvahill moved the Authority approve the transfer of the retail liquor store license to
Addis Enterprise, Inc. d/b/a Louisville Discount Liquor at 1140 Pine St. Unit 1
conditioned on the return of the fingerprint check showing no criminal history. Lipton
seconded the motion.

Attorney Light explained Authority Rule 5b requires the transfer to have the assent of
the current license holder. He explained this local rule is not one required by the state
and since this is a transfer by operation of law and the current licensee has been
evicted, the Authority needs to make a motion to waive that rule since the landlord is the
one signing this transfer application.

Mulvahill waived Rule 5b as a friendly amendment to his motion for this transfer
application. Seconder Lipton also accepted the friendly amendment.

Roll Call Vote: Koertje-yes, Mulvahill-yes, Wilson-yes, Lipton-yes and Rommelfanger-
yes. Motion adopted.

C. Setting of Boundaries and Public Hearing for new Tavern liquor license
application - The Lodge at Balfour Operations, LLC d/b/a The Lodge at
Balfour - 1855 Plaza Dr.

Mulvahill had questions about the application. Attorney Light commented there were
issues with the application needing completion. At this point, there can still be a motion
to set the boundaries and set the public hearing and the application issues will be
addressed before the public hearing.

Mulvahill moved the Authority set the boundaries as the city limits of the City of
Louisville and set the public hearing for August 30,2004. Lipton seconded.

Roll Call Vote: Koertje-yes, Mulvahill-yes, Wilson-yes, Lipton-yes and Rommelfanger-
yes. Motion adopted.

D. Discussion/Direction - House Bill 04-1021

Attorney Light reviewed the cover sheet concerning what surrounding communities are
doing about tastings at retail liquor stores.

4

G\UQUOR\2004\MINUTES\MINUTES JULY 04.DOC
