Zoning Use'; Interpretation <br />Case #1980-3 <br />BOARD OF APPEALS AND BOARD OF ADJUSTMENT MINUTES: PUBLIC HEARING -FOR <br />ZONING USE INTERPRETATION FROM THE LOUISVILLE MUNICIPAL CODE,(JOHN.! <br />BENDER, APPLICANT. MAY 15, 1980. <br />Community Building, 801 Grant Avenue, Louisville, Colorado <br />This Public Hearing was called to order immediately following the hearing <br />of Gary Handschumacher. Due to the lack of Quorum at the applicant's <br />previously scheduled Public Hearing on May 8, 1980, his case was granted <br />a continuance until this date. <br />1. ROLL CALL: <br />A. Present: <br />Robert Ross, Chairman. <br />Don Pickett, Vice -Chairman <br />Gil Reed, Member <br />Bob Davies, Member <br />Don Ross, Member <br />Ernest Barry, Associate Member <br />Staff Present: <br />Steve Ferris, Chief <br />Building Inspector and <br />• Secretary <br />B. Also present was the owner and applicant, John Bender. <br />2. CERTIFICATION OF PROPER PUBLIC NOTICE. <br />A. Chairman asks for Certification of proper Public Notice. <br />1. Secretary tells him that the Notice of Public Hearing was published <br />in the Louisville Times; April 23, 1980; and April 30, 1980. <br />a. Chairman brings out the fact that there should be a change in the <br />Notice of Public Hearing. The legal description for John Bender's <br />proposed project location is incorrect. <br />b. Reading from a letter sent by. Robert. Francis, President, First <br />Savings Investment Corporation, dated April 21, 1980; the Secretary <br />notes that the correct legal description should read: "The northerly <br />eighty feet of Tract B, Louisville North First Filing". The incor- <br />rect legal descrition read: "Tract B, Louisville North First Filing, <br />less Louisville North 5th Filing". <br />2. Letters notifying property owners within a 300 foot radius were <br />mailed on April 16, 1980. <br />3. APPLICANT MAKES HIS PRESENTATION. <br />A. Applicant wishes to construct a veterinary clinic on a site which <br />is zoned Community Commercial. Under Section 17.12.030 of the <br />Louisville Municipal Code an animal hospital or kennel is not <br />permitted in a C-C Zoning District. <br />
