Campbell: The other thing that I would like to point out is that he obtained the <br />property after the PUD was in place. So, he was well aware of what the existing <br />PUD was when he obtained the property. All the rest of us in the community, we <br />buy our property subject to the same things. I'd just like to read three more <br />paragraphs. <br />Sears: Do you have any other comments on the six conditions? <br />Campbell: No. I'd just like to read these. This Board only denied one variance last <br />year. That's a 94% success rate. Mr. Von Eschen can feel pretty confident. <br />Sears: Anything else? Thank you. I would like to point out to the Board that we <br />are not considering a change of use on this property. Move on to comments by <br />Staff. <br />Pendergrast: Maybe Mr. Von Eschen has some questions or comments for Mr. <br />Campbell. <br />Von Eschen: There are four (4) lots left in the subdivision. We are building on <br />Two (2) lots. There is one vacant lot (Lot 6). There are 4 lots out of 9 that have <br />not yet been completed so, from a substantial completion standpoint, I'm not sure <br />how that would weigh. What we are doing, based on the design of the building, <br />when he talks about benefits to a neighborhood, 1) we are completing construction <br />on this particular project so I feel that we are benefiting the neighborhood by <br />ending that activity; 2) the design, we feel, is extremely compatible with the <br />neighborhood, and, when we talk about neighborhood, Windsong is a piece of a <br />broader neighborhood that exists, and only 9 lots is not a large subdivision. The <br />original PUD stated that these 2 lots were set aside to take care of the character <br />part flowing around the corner to blend with Old Louisville. Having a house there <br />sets a tone. I have the plat that I was referring to when we originally purchased the <br />properties that had the setbacks that I was referring to. It wasn't our intention to <br />take a small lot like this and pay the same price that we did for the other ones. We <br />felt that this lot was larger and this is the document here that led us to believe that. <br />Sears: So this would be Exhibit No. 5. This is a plat of the Windsong Place <br />Subdivision showing some setbacks and designating that the setbacks along West <br />Street for Lots 8 & 9, and also the setback along Jefferson on Lot 9, is indicated as <br />having a 20 foot setback. <br />Von Eschen: You need to know that that particular one was not signed by the City <br />and that was changed at the last part. It took us quite awhile to find the one that <br />was changed, but Paul was successful in finding that. I want to make it clear that <br />that wasn't given to me by the City. It was given to me by the title company that <br />we closed with and I have issue with them. I have issue with myself more because <br />8 <br />
