Revitalization Commission <br />Minutes <br />January 13, 2021 <br />Page 5 of 9 <br />Commissioner Williams — yes <br />Motion passes <br />• Discussion/Direction- Public Infrastructure Assistance Agreement for <br />Corvus Nidus LLC, The Rose & Raven at 511 East South Boulder Road <br />Director Pierce said the applicant made their request for public infrastructure <br />assistance in December. They provided a presentation for planned <br />development of The Rose & Raven at 511 E. South Boulder Road. The LRC <br />has two applications: direct assistance and public infrastructure assistance. <br />Corvus Nidus is requesting public infrastructure assistance and the specific <br />summary of items for funding is included on page 24 of the packet. Today, the <br />draft agreement is before the LRC. Staff is asking for direction to take this to <br />Council for approval, then it will come back to LRC for final approval. <br />Director Pierce clarified that Corvus Nidus would be reimbursed at construction <br />acceptance. No funds are released until acceptance. <br />There was discussion related to the sale of Village Square and if that sale <br />would change anything for the development. Joshua Martinsons, representing <br />Corvus Nidus said the sale should not have an impact on the development. <br />The water main improvements are being made at the request of the City. It <br />would be hard to do further work in the water main in anticipation of future <br />development. <br />Commissioner Williams asked what public input has been gathered and what is <br />the reaction to the project? Public outreach was done for zoning. When concept <br />came to City Council there was no opposition. There was no public input or <br />reaction to LRC's consideration of this request. Mr. Martinsons said there has <br />been a lot of positive support rather than a lack of opposition. Council member <br />Leh noted this went before Planning Commission so this project has had a lot of <br />public process. <br />Commissioner Smith noted he knows the developer and asked if this is a <br />conflict of interest for him. Attorney Cotton -Baez said confidence in a developer <br />is not a reason to abstain. Financial interest would be. Commissioner Smith <br />clarified he has no financial interest. <br />Commissioner Tofte made a motion directing staff to forward the agreement to <br />Council. Chair Adler seconded.
