Section 4.8(c) Of the Charter of the City of Louisville ("Charter"). Section 3. The proposed Agreement for Purchase. and Sale of Water Stock f-A reement'), by and between the City and CK H2O Ventures, is hereby approved in essentially the same form as the copy of such Agreement accompanying this Ordinance. Settlers 4, The Mayor and City Clerk are authorized to execute such Agreement, and the Mayor is further authorized to negotiate and approve such revisions to said Agreement as the Mayor deter- mines are necessary or desirable for the protection of the City. so long as the essentlsl terms and conditions of the Agreement are not altered. Section S. The Mayor, City Clerk. city manager, Public Works Director, and Deputy Director of Utltitles are further authorized to do all things necessary on behalf of the City to perform the oblige- tiers of the City under such Agreement, and to execute and deliver any and all closing and other documents necessary to effect the Transfer under Me terms and conditions of said Agreement. Section 8, The Mayor. City Clerk. City Manager, Public Works Director. and Deputy Director of Utilities are further authorized to execute documentsand doall things necessary on behalf of the City to acquire the Easement Rights. Section 7. Unless otherwise required by Section 4-8(c) of the Charter, amendnients to the Agreement may be approved by Reso- lution of the City Cs/until. Section 8. If any portion of MIS Ordinance is held to be invalid for any reason, such decision shall not affect the validity of the re- maining portions of this Ordir ante. The City Council hereby de- clares that It would have passed this Ordinance and each part here- of irrespective of the fact that any part be declared Invalid. Section9, AEI other ordinances or portions thereof Inconsis• tent orconflicting with this Ordinance or any portion hereof are hereby repealed to the extent of such Inconsistency or conflict.
