C. If parking space has been provided in connection with an existing <br />structure or use or is added in connection with an existing structure or use, the <br />existing parking space shall not be eliminated if elimination would result in less <br />space for the existing floor area than the ratio set forth in Subsection A of this <br />Section. Therefore, existing parking may be credited to the parking requirement of <br />Subsection A of this Section only if the existing parking space exceeds a ratio of one <br />parking space per 400 square feet of existing floor area for the structure to be <br />enlarged. <br /> D. In addition to the criteria set forth in Section 17.20.080 and, when <br />applicable, Section 17.28.110, the City Council may waive or modify the parking <br />requirements applicable to Downtown Louisville when the applicant has <br />demonstrated that by alternative methods acceptable to the City Council adequate <br />parking space is and will remain available for the proposed structure or use, even <br />though the alternative method by which the parking space is provided does not <br />otherwise comply with all requirements of this Chapter. <br /> E. The requirements of this Section shall take effect June 7, 1999, and <br />shall apply to each new structure and each enlargement of an existing structure <br />within Downtown Louisville for which a building permit has not been issued as of <br />such date. <br /> F. This Section shall not apply to the erection or enlargement of any <br />parking structure. <br /> <br /> Section 5. Section 17.20.090 of the Louisville Municipal Code is hereby amended to <br />read as follows (words to be added are underlined; words to be deleted are ~): <br /> <br /> B. Other required parking space shall be located in the same zone or a <br />zone which is less restrictive in use and shall be located no farther than seven <br />hundred feet from the building or use they are required to serve_. <br />~:~k~ ~:.~ c~ ,k~ k..:~:~ This distance shall be computed by direct <br />measurement from the nearest portion of the parking space to the nearest portion of <br />the building served or area dedicated to the use served, using a route of direct <br />pedestrian access, measured as a person would walk safely and properly, without <br />trespassing, with right angles at crossings and with the observance of traffic <br />regulations and lights. <br /> <br /> Section6.
