ORDINANCE NO. 1285 <br />SERIES 1998 <br /> <br />AN ORDINANCE AMENDING CHAPTER 17.28 OF THE LOUISVILLE MUNICIPAL <br />CODE TO PLACE A TIME LIMIT ON APPROVALS OF FINAL DEVELOPMENT PLANS <br />FOR COMMERCIAL AND INDUSTRIAL PLANNED UNIT DEVELOPMENTS. <br /> <br /> WHEREAS, substantial delay in the development of a commercial or industrial planned unit <br />development can have an adverse effect on the neighborhood and community as a result of changing <br />conditions, changes in the City's master plan, changing community needs and desires, and for other <br />reasons; and <br /> <br /> WHEREAS,the City Council finds it is in the best interest of the City to place a reasonable <br />time limit on the development of a commercial or industrial planned unit development. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. Section 17.28.200 of the Louisville Municipal Code is hereby amended to add <br />a new paragraph E to read as follows: <br /> <br />17.28.200 Construction procedures and building permits. <br /> <br /> E. Notwithstanding any other provision of this Chapter 17.28, for any <br />area covered by a final development plan for a commercial or industrial planned unit <br />development approved after November 9, 1998, No building permit shall be issued <br />more than thirty-six (36) months after City Council approval of the plan unless an <br />extension of time is approved pursuant to § 17.28.210.B. and issuance is within such <br />extended time. <br /> <br /> Section 2. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br />that any one part be declared invalid. <br /> <br /> Section 3. The repeal or modification of any provision of the Municipal Code of the City <br />of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole or in <br />part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred under <br />such provision, and each provision shall be treated and held as still remaining in force for the <br />purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the <br />enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any <br />judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, <br />proceedings, or prosecutions. <br /> <br /> <br />
