IIfIIIYII~YII^I IIII OIIINYI~IIIIRII 2992995 <br />WHEREAS, the City Council desires to approve the application and vacate the City's <br />interests in the temporary secondary emergency vehicle access easement and the temporary bike <br />path easements for which vacation is requested. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City hereby vacates the City's interests in the temporary secondary <br />emergency vehicle access easement and the 15-foot temporary bike path easement dedicated to the <br />City by the plat of Spruce Lane Subdivision, recorded on September 22, 1987 at Reception No. <br />00878399, Plan File P-21, F-2, #42-#43, Boulder County Records, which vacated temporary <br />emergency vehicle access easement and 15-foot temporary bike path easement are located within <br />portions of Lots 2, 3, 4, and 6, Block 4, and Lot 8, Block 5, Spruce Lane Subdivision, and which <br />vacated easements are depicted in Exhibit A, attached hereto and incorporated herein by reference. <br />Title to the vacated easements shall vest in the manner provided by law. <br />Section 2. The City hereby vacates the City's interests in the temporary bike path <br />easement granted to the City by that certain Grant of Easement and Right-of--Way recorded in the <br />Office of the Boulder County Clerk and Recorder on February 18, 1994, at Reception No. 0139664, <br />which easement is over a portion of Lot 6, Block 4, Spruce Lane Subdivision, as further described in <br />said instrument. <br />Section 3. The City hereby vacates the City's interests in the temporary bike path <br />easement granted to the City by that certain Grant of Easement and Right-of--Way recorded in the <br />Office of the Boulder County Clerk and Recorder on February 18, 1994, at Reception No. 0139665, <br />which easement is over a portion of Lot 8, Block 5, Spruce Lane Subdivision, as further described in <br />said instrument. <br />Section 4. The City specifically reserves all interests in the utility easements within the <br />aforementioned Lots, including the perimeter utility easements denoted on said plat; those easements <br />denoted on said plat as the "15' Permanent Utility Easement (U.E.)" and the "Utility Easement <br />(U.E.) Permanent; and any utility easements granted under the above-referenced instruments <br />recorded at Reception Nos. 0139664 and 0139665. Such utility easements are not vacated and <br />ownership thereof shall be and remain vested in the City. Further, any easements for other public <br />utilities shall not be altered or amended by virtue of this ordinance. <br />Section 5. The Mayor, City Manager and City Clerk are hereby authorized to execute <br />such additional documents as may be necessary or appropriate to evidence the vacation of the <br />temporary secondary emergency vehicle access easement and the 15-foot temporary bike path <br />easements herein vacated, including but not limited to execution of quit claim deeds. <br />2 <br />
