<br />Planning Commission <br />Meeting Minutes <br />OCTOBER 9, 2008 <br />Page 6 of 11 <br />. On July 10, 2008 the Planning Commission conducted a public hearing <br />for the development of 19 units: 14 townhome units in 5 buildings and 5 <br />single family homes. At that meeting the Commission passed a motion <br />(6 to 0) of disapproval with direction to staff to prepare findings for <br />disapproval. The motion also stated the findings were to be prepared for <br />the August 14, 2008 public hearing when the Commission would review <br />the findings and finalize their recommendation. <br />. On August 14, 2008 the Commission reviewed and approved findings <br />prepared by staff as incorporated into Resolution No. 13, Series 2008. <br />After receiving staff comments and final comments from the applicant <br />the Commission passed a motion (7 to 0) to approve Resolution No. 13, <br />Series 2008, a resolution of disapproval on the project. <br />. The recommendation of disapproval was forwarded to City Council for <br />the August 19, 2008 meeting. <br />. City Council deliberated and by a vote of 7:0 remanded the application <br />back to Planning Commission for further discussion on the issues <br />regarding density, alley width, access and roof pitch. The Council also <br />reaffirmed the findings of the Planning Commission that the proposed <br />density should be in alignment with the Residential Medium (RM) zoning <br />maximum of 15 units. <br /> <br />Wood provided the following summary of the proposed Preliminary Subdivision <br />Plat: <br />. Staff comments are focused on the analysis of the public-use dedication, <br />the provision of required access and utility easements, the proposed <br />grading plan and the requirements of the Louisville Fire Protection <br />District. <br />. It is the position of staff, as affirmed by the City Attorneys office, that the <br />Parbois Subdivision Plat is required to create and dedicate, lots, tracts, <br />or parcels and therefore constitutes a subdivision of the property. <br />. The position of the Subdivider, per a letter dated March 13, 2008 from <br />Jung & Associates, P.C., that the property is exempt from meeting the <br />requirements of a public use dedication as the property has been <br />previously platted. <br />. The Departments of Parks and Recreation and Planning recommend the <br />Subdivider meet the public use dedication requirement in the form of a <br />payment in lieu of land dedication. The payment would be based on 15% <br />of the total appraised land value. <br />. The applicant has provided a preliminary grading plan to delineate the <br />anticipated grades for the development. The grading plan proposed to fill <br />portions of the property to an elevation of 5,332 feet, which represents <br />the extent to which the fill would be limited to the minimum necessary to <br />bring structures to the compliant elevation of the approved Flood Plain <br />Development Permit. <br /> <br />Wood provided the following summary of the proposed Preliminary Planned Unit <br />Development (PUD) Plan: <br />
