FIRST AMENDMENT TO INTERGOVERNMENTAL AGREEMENT <br />FOR SHARING OF COSTS OF A CONCEPTUAL DESIGN PLAN FOR THE <br />RECONFIGURATION OF STATE HIGHWAY 42 <br />This FIRST AMENDMENT TO INTERGOVERNMENTAL AGREEMENT ("First <br />Amendment") is made and entered into this 4tn day o 2021, by and between the City of <br />Lafayette, a Colorado home rule municipality ("Lafaye tie"), and the City of Louisville, a <br />Colorado home rule municipality ("Louisville") (together, the "Parties"). <br />WHEREAS, Lafayette and Louisville are parties to that certain Intergovernmental <br />Agreement for Sharing of Costs of a Conceptual Design Plan for the Reconfiguration of State <br />Highway 42, dated October 6, 2020 (the "Original Agreement"); and <br />WHEREAS, under the Original Agreement, the Parties agreed to share the costs of <br />developing a plan and initial design (15%) for that portion of the State Highway 42 corridor <br />extending between Empire Road in Louisville and Arapahoe Road (State Highway 7) in Lafayette <br />(the "Plan"); and <br />WHEREAS, under the Original Agreement, the Parties estimated the Plan to cost <br />$437,500, to which total $350,000 in Federal Transportation Improvement Program grant funds <br />would apply; and <br />WHEREAS, the Parties agreed to split the remaining cost to complete the Plan equally, <br />and estimated an $87,000 local match ($43,750 each) to complete the Plan; and <br />WHEREAS, the Parties have determined the actual cost of the Plan to be $662,784, with <br />a local match of $312,784 ($156,392 each) after applying the grant funds; and <br />WHEREAS, due to the substantial increase in project costs and the local match, the Parties <br />now desire to amend the Original Agreement; and <br />WHEREAS, the Parties are authorized to enter into this First Amendment pursuant to <br />C.R.S. § 29-1-201, et seq. <br />NOW THEREFORE, in consideration of the foregoing and the mutual promises <br />contained herein and in the Original Agreement, the Parties agree as follows: <br />Section 1. Section 3 of the Original Agreement is hereby amended to read as follows <br />(words added are shown in double underline; words deleted are sken thr-e): <br />3. Plan Costs. The Parties have estimated the Plan to cost 662 784 <br />$437,500 and agree that $350,000 in Grant funds shall be applied toward the <br />development of the Plan.
