<br />IES 2021. CONCERNING LOCAL FACE COVERING REQUIREMENTS
<br />WHEREAS, the City of Louisville (the "City") is a home -rule cittyy
<br />and municipal corporation duty organized and existing under an
<br />pursuant to Article XX of the Colorado Constitution and Charter di
<br />the City;. and
<br />WHEREAS, the NovelCoronavtrus 2019 (COVID'19) Pandemic
<br />is causing widespread human and economic Impacts to the City of
<br />Lewisville; and
<br />WHEREAS, on March 15 2020, the Mayor of the CI of Louis-
<br />ville purse Chapter 232 of the Louisville Municipal Code and
<br />C.R.S. . } 24-33.5-700, executed a Declaration of Local Disaster Emer-
<br />ggcenncy In and for the City of Louisville (the `Mayor's Declaration"):
<br />WHEREAS by Resolution No. 27 adopted on March 16, 2020.
<br />the City Council continued in effect the Mayor's Declaration until
<br />terminated by resolution of the City Council; and
<br />WHEREAS. on Mardi 25, 2020, Governor Jared Polls Issued Ex-
<br />ecutive Order D2020.017 (the "Statewide

<br />WHEREAS, in the Boulder County Stay -at -Home Order, BCPH

<br />wide Stay -at -Home Order) have not abated in Boulder County"; and
<br />WHEREAS. on April 26, 2020, Governor Polls Issued Executive
<br />Order D2020.044. introducing the "Safer at Home" phase of slightly
<br />relaxed regulationwhich permitted some non•cnticai business¢
<br />to open witi0hhu certain restrictions beginning May1, 2020 and wide
<br />regulation became effective within the City ofLouisvilleupon the
<br />expiration of the Boulder County Stay -at -Home Order, and
<br />WHEREAS, on May 5.2020, the City Council adopted Ordinance
<br />Nfto. 1793, Series 2020, an Emergency Ordinance Requiring the Wear
<br />in0 of Face Coveringgss within the City, which ordinance, as amend-
<br />ed, expired August 30.2020; and
<br />WHEREAS. on August 18, 2020. the City Council adopted Ordi-
<br />nance No. 1799. Series 20, an Emergency Ordinance Amending
<br />and Restating the Requirement to Wear a Face Covering In the City
<br />of Louisville, which extended the City's face covering requirement
<br />until arnended or repealed by Ordinance of INC City Council; and
<br />WHEREAS. on April 3, 2021, Governor Polis enacted Executive
<br />Order No. D2021.079, Ordering Individuals in Colorado to Wear Non.
<br />Medical Face Coverings; and
<br />WHEREAS on April 2, 2021. Boulder County Public Health Is-
<br />sued Public Health Order 2021.03 which imposed face covering re-
<br />quirements that were more restrictive than those that were enact-
<br />ed by the state the following day; and
<br />WHEREAS, on April 6. 2021 the City Council adopted Ordi-
<br />nance

<br />and Restating the Requirement to Wear a Face Covering In the City
<br />of Louisville which revised the City's face covering reqUuirements to

<br />WHEREAS. on Mai! 13, 2021, the Centers for Disease Control
<br />and Prevention (the CDC") outlined new mask guidance for
<br />vaccinated and unvaccinated individuals; and
<br />WHEREAS. on May 14, 2021. Governor Polls Issued Executivee
<br />order 2021-103, in accordance with the CDC mask guidance, which
<br />Order requires, with certain exceptions, only those persons who are
<br />eleven (11) years of age and older and who are not fully vaccinated
<br />to wear face coverings when entering or within an Indoor public
<br />space where members of different households are present; and
<br />WHEREAS, as of May 11. 2021. more than sixty-three percent
<br />(63%) of people residing in the Denver metropolitan area have re-
<br />ceived the COVID-19 vaccine: and
<br />WHEREAS. in Boulder Count more than 192,000 people have
<br />been vaccinated, seventy percent (7096) Of the eligible population.,
<br />and vaccine distribution continues within Boulder County at a rate
<br />of 2489 doses per day; and
<br />WHFetrai, the City Council finds it to be in the best Interest of
<br />the City and its residents and businesses to repeal its local face
<br />covering ordinance, so that the wearing of face coverings within'
<br />the City will be governed by orders issued by !Mulder County Public
<br />Health, as such requirements may be amended or repca1ed;and
<br />WHEREAS, the City Council finds that an emergency exists be-
<br />cause the preservation Of public property. health, safety. and wel•
<br />fare requires the City to take immediate action to ensure the health
<br />of all City residents, public and private employees. business pa-
<br />trons. and to ensure recipients of government services are protect-
<br />ed to cite greatest extent possibte from transmission of COVID•19
<br />while engaging In commercial and governmental transactions with-
<br />in the CITY during the Pandemic.
<br />NOW THEREFORE, BE IT ORDAINED or THE CITY COUNCIL OF
<br />THE CiTY of LOUISVILLCOLORADO:

<br />Section 2, Effective Date This ordinance shall become effec-
<br />tive on the date the updated Boulder County Public Health Order is
<br />made effective.
