RESOLUTION NO. 38 <br />SERIES 2021 <br />A RESOLUTION APPROVING A COOPERATION AGREEMENT BETWEEN THE <br />CITY OF LOUISVILLE AND THE LOUISVILLE REVITALIZATION COMMISSION <br />REGARDING FUNDING TO ENHANCE THE DOWNTOWN PATIO PARKLET <br />PROGRAM <br />WHEREAS, the City of Louisville (the "City") is a home -rule city and municipal <br />corporation duly organized and existing under and pursuant to Article XX of the Colorado <br />Constitution and Charter of the City; and <br />WHEREAS, the Louisville Revitalization Commission (the "LRC") is a public body <br />corporate and politic authorized to transact business and exercise its powers as an urban renewal <br />authority under and pursuant to the Colorado Urban Renewal Law, Part 1 of Article 25 of Title 31, <br />C.R.S. (the "Act"); and <br />WHEREAS, the Act and Section 18, Article XIV of the Colorado Constitution authorize <br />the City and the LRC to enter into cooperation agreements, and the Act specifically authorizes the <br />City and the LRC to enter into agreements respecting action to be taken pursuant to any of the <br />powers set forth in the Act; and <br />WHEREAS, the City has an established history of providing outdoor dining programs in <br />downtown Louisville, including an outdoor patio program wherein the City rents businesses City - <br />owned patio parklets within City right-of-way adjacent to the businesses (the "Program"); and <br />WHEREAS, due to pandemic budget constraints, there are not budgeted patio purchases <br />in the City's Capital Improvement Plan that would accommodate new participants desiring to <br />provide outdoor dining options to customers; and <br />WHEREAS, based on increase demand for outdoor dining options, and the expectation <br />that the demand for outdoor dining will continue to increase in future seasons, the LRC has <br />expressed interest in enhancing the Program by increasing the number of downtown patio parklets <br />and canopy systems available to downtown businesses by providing some level of financial <br />assistance for their purchase (the "Project"); and <br />WHEREAS, with City Council's approval of a temporary closure of Main Street for <br />expanded dining from April 26 through November 1, 2021, the City's purchase of additional patio <br />parklets and canopy systems is not expected to occur until late 2021; and <br />WHEREAS, if and when the City resumes the Program in 2022, it is anticipated that patio <br />parklets would again be rented to downtown businesses; and <br />WHEREAS, the Project is located within the area (the "Plan Area") described in the <br />Highway 42 Revitalization Area Urban Renewal Plan (the "Plan"); and <br />WHEREAS, the Plan provides for financing the activities and undertakings of the LRC by <br />Resolution No. 38, Series 2021 <br />Page 1 of 2 <br />
