<br />WHEREAS, the City of Louisville (the "City"). Is a Colorado home
<br />rule municipal corporation duly organized and existing under laws
<br />o1 the State of Colorado and the Charter for the City of Louisville,
<br />Colorado (the "City Charter'): and
<br />WHEREAS, the members of the City Council of the City (the "City
<br />Council') have been duly elected and qualified; and
<br />WHEREAS. Article X. Section 20 of the Colorado Constitution, also
<br />referred to as the Taxpayers Bill of Rights (•TABOR") requires voter
<br />approval for any new tax, any Increase In any tax rate, lire creation
<br />of any debt, and the spending of certain funds above limits eslab-
<br />eshod by TABOR; and
<br />WHEREAS, pursuant to Article 12 and section 4-8 of the City Char.
<br />ter, lac City may authorize the Issuance of bonds, the imposition of
<br />new taxes and the Increase of a tax rate by ordinance and upon ap-
<br />proval of the registered electors of the City; and
<br />WHEREAS, the City Council has determined the interest of the City
<br />and the public Interest and necessity demand and require the ac-
<br />quisition described in therobaalllot questttioonlnssoSt forth In
<br />tion Section improvements. ef. ell
<br />Data cost estimated at approximately S51.420,000'(the "Prefect,;
<br />WHEREAS, the City Council is of the opinion that the City should in-
<br />cur debt and increase the City 1 property tax mill levy for the pay-
<br />ment of such debt, as further stated in this ordinance; and
<br />WHEREAS, TABOR requires that the City submit ballot Issues, as de-
<br />fined in TABOR. to the City's reentered electors 0n specified elect
<br />don days before action can be taken on such ballot issues; and
<br />WHEREAS. the City will hold a regular munlclpal election on Novem-
<br />ber 2. 2021; and
<br />WHEREAS, November 2. 2021. Is one of the election dates at which
<br />TABOR ballot Issues may be submitted to the registered electors of
<br />the City pursuant to TABOR; and
<br />WHEREAS the County Clerk and Recorder for Boulder County (the
<br />County Clerk") will conduct the election on November 2, 2021 as a
<br />coordinated mall ballot election pursuant to the Uniform Election
<br />Code of 19e2 as amended: and
<br />WHEREAS,the City Council finds it is in the best interest of the City
<br />to refer a TABOR ballot issue to a vote of the registered electors of
<br />the City at the November 2 2021. municipal election pursuant to Ar-
<br />ticle X, Section 2q of the Colorado Constitution.
<br />NOW THEREFORE, BE ITCR ORDAINED BY THE Y COUNCIL OF
<br />THE CITY OF LOUISVILLE, C0L0RAD0;
<br />Section 1. The regular munklpal election of the City to be field
<br />on November 2, 2021,shall be held and conducted as part of a coor-
<br />dinated mail ballot eection to be conducted by the County Clerk in
<br />accordance with the Uniform Election Code of 1992, as amended.
<br />Section 2. pursuant to applicable provisions of the laws of the
<br />State of Colorado and the Charter for the Cityof Louisville, Calera-

<br />Section 3. The following ballot Issue, certified In substantially
<br />the form set forth below IS hereby referred to the registered elec•
<br />tors of the City and shall appear on the ballot f the City of Louis-
<br />ville regular election to be held on November 2, 2021:
<br />SHALL CITY OF LOUISVILLE DEBT BE INCREASED S51420000, WITH
<br />A REPAYMENT COST OF UP TO $90,240,000; AND SHALL CITY PROP-
<br />ERTY TAXES 8E INCREASED UP TO 53.786.00e ANNUALLY. OR BY
<br />SUCH LESSER AMOUNT AS MAY BE NECESSARY TO PAY SUCH DEBT
<br />FROM AN ADDITIONAL AD VALOREM PROPERTY TAX MILL LEVY
<br />NOT TO EXCEED 5.450 MILLS SUBJECT TO THE FOLLOWING CONDI-
<br />T10NS:.
<br />(1) SUCH DEBT AND TAXES SHALL 8E USED FOR THE PURPOSE OF
<br />FINANCING THE ACQUISITION AND CONSTRUCTION OF TRANSPOR-
<br />TATION IMPROVEMENTS INCLUDING BUT NOT LIMITED TO
<br />UNDERPASSES, BIKE PATHS, PEDESTRIAN WALK WAYS, TRAILS,
<br />AND RELATED IMPROVEMENTS OR TO REFUND SUCH DEBT AT A
