WHEREAS, the City Council is mindful that some residents have had, have, or may have <br />in the future financial challenges in paying their utility bills, the City Council expects City Staff to <br />work with those residents to consider waiving late fees and penalties, establishing payment plans <br />as appropriate, and notifying them of community and government resources that may be able to <br />assist them in meeting their obligations. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. Those provisions of Chapter 13.12 of the Louisville Municipal Code (Water <br />Service Rates and Fees) that were temporarily suspended by Ordinance No. 1792 are hereby <br />reinstated. <br />Section 2. As provided in Section 2 of Ordinance No. 1792, during the time that <br />Ordinance No. 1792 was in effect, and hereafter, all charges imposed pursuant to Chapter 13.12 for <br />water service were and shall remain a lien on the property served from the time the charge was due <br />until paid, as set forth in Section 13.12.130 of the Louisville Municipal Code. City staff is authorized <br />and encouraged to enter into payment plans with water customers who have accumulated significant <br />past -due balances during the COVID-19 Pandemic, with terms and conditions to be approved by the <br />Finance Director, provided such payment plans provide a steady decrease in the amount of the past - <br />due balance and current water charges are paid in full each month. <br />Section 3. This ordinance shall become effective upon adoption. Late fees may be <br />imposed, and water service may be disconnected, if full payment of all delinquent charges for <br />water, wastewater, and stormwater services have not been received in the City offices before the <br />close of business on September 30, or alternative arrangements made by a payment plan <br />approved by the City's Finance Director. <br />Section 4. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br />that any one part be declared invalid. <br />Section 5. The repeal or modification of any provision of the Louisville Municipal Code <br />by this ordinance shall not release, extinguish, alter, modify, or change in whole or in part any penalty, <br />forfeiture, or liability, either civil or criminal, which shall have been incurred under such provision, <br />and each provision shall be treated and held as still remaining in force for the purpose of sustaining <br />any and all proper actions, suits, proceedings, and prosecutions for the enforcement of the penalty, <br />forfeiture, or liability, as well as for the purpose of sustaining any judgment, decree, or order which <br />can or may be rendered, entered, or made in such actions, suits, proceedings, or prosecutions. <br />Section 6.
