ORDINANCE NO. 1298 <br />SERIES 1999 <br /> <br />AN ORDINANCE AMENDING TITLE 17 OF THE LOUISVILLE MUNICIPAL CODE TO <br />ADOPT ADDITIONAL REGULATIONS CONCERNING SEXUALLY ORIENTED <br />BUSINESSES WITHIN THE CITY OF LOUISVILLE; AND AMENDING TITLE 5 OF THE <br />LOUISVILLE MUNICIPAL CODE TO ADOPT A NEW CHAPTER 5.18, CONTAINING <br />LICENSING AND OTHER REQUIREMENTS FOR SEXUALLY ORIENTED <br />BUSINESSES. <br /> <br /> WHEREAS, by Ordinance No. 541, Series 1977, the City of Louisville adopted certain <br />separation requirements and other regulations concerning adult theaters, adult bookstores, adult <br />photO studios, and similar sexually oriented businesses; and <br /> <br /> WHEREAS, since that time, there have been significant developments with respect to the <br />regulation and licensing of sexually oriented businesses, and there have been numerous court <br />decisions concerning such regulation and licensing of sexually oriented businesses; and <br /> <br /> WHEREAS, the City Council desires to amend Title 17 of the Louisville Municipal Code, <br />entitled "Zoning", to update the City's zoning regulations with respect to the location and separation <br />of, and other matters concerning, sexually oriented businesses; and <br /> <br /> WHEREAS, the City Council further desires to amend Title 5 of the Louisville Municipal <br />Code, entitled "Business Licenses and Regulation", to adopt a new Chapter 5.18 containing licensing <br />and other requirements for sexually oriented businesses; and <br /> <br /> WHEREAS, sexually oriented businesses in the City of Louisville, Colorado require <br />regulation in order to protect, preserve and promote the health, safety and welfare of the citizens of <br />the City as well as the patrons of such businesses, through a comprehensive ordinance regulating <br />such businesses; and <br /> <br /> WHEREAS, the City Council and City Staff have received and reviewed land use studies, <br />summaries of studies, surveys, and other documents concerning the secondary effects of sexually <br />oriented business in the U.S. cities listed in Appendix A to this ordinance; and <br /> <br /> WHEREAS, from review of such documents and testimony of its citizens and others, the <br />City Council finds that there is convincing evidence that sexually oriented businesses, because of <br />their very nature, have a deleterious effect on surrounding businesses and residential areas adjacent <br />to them; and <br /> WHEREAS, the City Council finds that sexually oriented businesses have a deleterious <br />effect on nearby public facilities, schools and public places of worship, and on the image of the City <br />of Louisville as an attractive residential community; and <br /> <br />WHEREAS, the City Council finds that sexually oriented businesses, by their very nature, <br /> <br /> <br />
