for a period of thirty (30) days or more. Such business shall not be enlarged, <br />extended, or altered except that the business may be brought into compliance with <br />this subsection. <br /> H. If two or more sexually oriented businesses are within one thousand <br />(1,000) feet of one another and otherwise in a permissible location, the sexually <br />oriented business which was first established and continually operating at the <br />particular location will be deemed to be in compliance with subsection B of this <br />section and the later established business(es) will be deemed to be in violation of <br />such subsection. <br /> I. A sexually oriented business which at the time it received its sexually <br />oriented business license was in compliance with the location requirements of <br />subsection B of this section does not violate that subsection if when the sexually <br />oriented business applies to renew its valid sexually oriented business license a <br />school is now located within one thousand five hundred (1,500) feet of the sexually <br />oriented business; or a church, public building, dwelling or residential zone district <br />is now located within one thousand (1,000) feet of the sexually oriented business. <br />This provision applies only to the renewal of a valid sexually oriented business <br />license and does not apply to an application for a sexually oriented business license <br />that is submitted as a result of the previous sexually oriented business license <br />expiring or being revoked. <br /> <br /> Section 12. Section 17.72.070 of the Louisville Municipal Code is hereby amended to <br />read as follows (words added are underlined; words deleted are ~): <br /> <br />17.72.070 Planning Area. <br /> The term planning area, as used herein, shall be defined as an area within a <br />planned community zone district, as shown on the adopted planned community <br />general development plan. The planning areas are designated as to general land use <br />categories, such as residential, commercial, industrial, agricultural, office and public <br />uses. Unless otherwise specified by the adopted planned community general <br />development plan, the uses permitted within each planning area and the <br />corresponding development standards shall be as set forth herein. No sexually <br />oriented business shall be permitted within any planned community zone district. <br /> <br /> Section 13. Title 5 of the Louisville Municipal Code is hereby amended by the addition <br />of a new Chapter 5.18, entitled Sexually Oriented Businesses, to read as follows: <br /> <br />Chapter 5.18 <br /> <br />SEXUALLY ORIENTED BUSINESSES <br /> <br />5.18.010 Purpose and intent. <br /> The purpose and intent of this Chapter is to regulate sexually oriented <br />businesses to promote the health, safety, and general welfare of the citizens of the <br /> <br /> <br />
