ORDINANCE NO. 1297 SERIES 1999 AN ORDINANCE AMENDING CHAPTER 10.18 OF THE LOUISVILLE MUNICIPAL CODE TO FURTHER DEFINE THE AREA OF THE CITY OF LOUISVILLE WITHIN WHICH A PARKING PERMIT SYSTEM MAY BE ESTABLISHED FOR ON -STREET PARKING AND PUBLIC PARKING LOTS. WHEREAS, the City Council by Ordinance No. 1288, Series 1998, established a permit system for on- and off-street parking on designated streets and within designated public parking lots in areas of downtown Louisville that are zoned primarily for commercial use; and WHEREAS, the City Council by Ordinance No. 1288, Series 1998, also established a permit system for on -street parking on designated streets in areas of downtown Louisville that are zoned primarily for residential use; and WHEREAS, the City Council desires to define the areas within which such parking permit systems may be established. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. Section 10.18.010 of the Louisville Municipal Code is hereby amended by the addition of a new subsection E, to read as follows (words added are underlined): 10.18.010 City Administrator authorized to designate permit zones and lots. E. For purposes of this Chapter, the downtown Louisville area within which the City Administrator is authorized to designate parking permit zones or lots includes all of Downtown Louisville, as defined in Chapter 17.08 of this Code, and all of that certain Old Town Overlay District set forth on the official Zone District Map of the City of Louisville. Section 2. If any portion of this ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact that any one part be declared invalid. Section 3. The repeal or modification of any provision of the Municipal Code of the City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred under such provision, and each provision shall be treated and held as still remaining in force for the purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, proceedings, or prosecutions.
