<br />AN ORDINANCE AMENDING ARTICLE VI, SECTION 1 OF ORDINANCE
<br />NO. 544, MAY 17, 1977, AS AMENDED BY ORDINANCE NO. 994, MAY 16,
<br />1989, AND ORDINANCE NO. 1258, MAY 6, 1997, TO EXTEND TO AND
<br />INCLUDING JUNE 15, 2001 THE ELECTRIC AND GASEOUS FUEL
<br />FRANCHISE GRANTED BY THE CITY OF LOUISVILLE, COLORADO,
<br />TO PUBLIC SERVICE COMPANY OF COLORADO.
<br />
<br /> WHEREAS, the electric and gaseous fuel franchise granted by the City of Louisville,
<br />Colorado, to Public Service Company of Colorado by Ordinance No. 544, May 17, 1977, as
<br />amended by Ordinance No. 994, May 16, 1989, and Ordinance No. 1258, May 6, 1997 ("franchise"),
<br />is to terminate June 16, 1999, unless extended; and,
<br />
<br /> WHEREAS, the City Council of the City of Louisville believes the franchise should be
<br />extended for a period of two years in order to permit adequate consideration of any proposed changes
<br />tO the franchise and to allow time for completion of legislative reviews and actions applicable to
<br />electric and gas companies which may affect the franchise.
<br />
<br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
<br />OF LOUISVILLE, COLORADO:
<br />
<br /> Section 1. Article VI, Section 1, of Ordinance No. 544, May 17, 1977, as amended by
<br />Ordinance No. 994, May 16, 1989, and Ordinance No. 1258, May 6, 1997, is hereby repealed and
<br />reenacted, with amendments, to read as follows:
<br />
<br />ARTICLE VI.
<br />
<br /> Section 1. Term Effective Date. This ordinance shall become effective,
<br />as provided by law, thirty days after its publication following final passage, upon
<br />acceptance in writing by the Company within said period, and the terms, conditions
<br />and covenants thereof shall remain in full force and effect to and including June 15,
<br />2001.
