City Council <br />Meeting Minutes <br />August 24, 2021 <br />Page 2 of 10 <br />City Attorney Kelly stated that regarding the authority for the executive session, Section 5- <br />2(c) of the Home Rule Charter authorizes an executive session for the purpose of <br />consideration of real property acquisitions and dispositions by the City, but only as to <br />appraisals and other value estimates and strategy for the acquisition or disposition of <br />such property. An executive session for this purpose is also authorized by the Open <br />Meetings Law, Section 24-6-402(4)(a) of the Colorado Revised Statutes. This request is <br />specifically related to a piece of property owned by the City. <br />MOTION: Mayor Stolzmann moved to go into executive session for the purpose of <br />consideration of real property acquisitions and dispositions and that the executive session <br />include City Manager Balser, Deputy City Manager Megan Davis; Economic Vitality <br />Director Megan Pierce, and City Attorney Kathleen Kelly. Mayor Pro Tern Maloney <br />seconded the motion. <br />VOTE: Motion passed by unanimous roll call vote. <br />Council went into executive session at 5:05 pm; Council returned from executive session <br />at 5:50 pm. <br />REPORT — DISCUSSION/DIRECTION/ACTION — REAL PROPERTY <br />ACQUISITIONS/DISPOSITIONS <br />City Attorney Kelly stated no follow-up is requested at this time regarding the real property <br />acquisitions and dispositions. She also noted that City Manager Balser was not in <br />attendance at the executive session. <br />RESOLUTION NO. 59, SERIES 2021 — A RESOLUTION APPROVING A BUSINESS <br />ASSISTANCE AGREEMENT WITH SNARF'S LOUISVILLE LLC FOR AN ECONOMIC <br />DEVELOPMENT PROJECT IN THE CITY OF LOUISVILLE <br />Director Pierce stated Snarf's Louisville LLC, DBA Snarf's Sandwiches, is considering an <br />expansion of its sandwich shop concept to Louisville at 1110 E. South Boulder Road. This <br />location has not been a sales tax generating location since 2005. The applicant <br />anticipates renovating the project location and opening by the end of 2021 with <br />approximately 20 employees, with job salaries of $30,000 per year. <br />The application meets the Business Assistance Criteria by retaining basic jobs to the City; <br />drawing new customers, it is not expected to draw a large percentage of its business from <br />existing businesses; it creates new sales tax to the City; and utilizes an existing building. <br />The proposed 50% rebate of Building Permit Fees and Construction Use Tax (for tenant <br />finish work) is capped at $5,000. The proposed 50% rebate on new sales tax over a five- <br />year period is capped at $90,000. The project must be completed by April 30, 2022 and <br />the business must remain in Louisville for a period of seven years or a percentage of <br />rebates received must be repaid. <br />
