ORDINANCE NO. 1294 <br />SERIES 1999 <br /> <br />AN ORDINANCE AMENDING TITLE 17 OF THE LOUISVILLE MUNICIPAL CODE <br />TO SET A MAXIMUM FLOOR AREA WITHIN THE WESTERLY PORTION OF <br />"DOWNTOWN LOUISVILLE," AS DEFINED HEREIN. <br /> <br /> WHEREAS, the City of Louisville, Colorado, is a statutory municipality existing under and <br />by virtue of the laws of the State of Colorado; and <br /> <br /> WHEREAS, C.R.S. §31-23-301 et seq. autl~orizes the City to establish zoning districts and <br />zone district regulations within the City for the purpose of, among other things, promoting the <br />general welfare of the inhabitants of the City; and <br /> <br /> WHEREAS, C.R.S. §24-67-101 et seq. authorizes the City to allow for planned unit <br />developments (PUDs) within the City and to adopt procedures and standards pertaining to PUDs; <br />and <br /> <br /> WHEREAS, pursuant to such authorities, the City has established zoning districts and <br />zoning and PUD regulations as codified in Title 17 of the Louisville Municipal Code; and <br /> <br /> WHEREAS, under C.R.S. §31-23-301, the City is empowered to regulate and restrict, <br />among other things, the size of buildings and other structures; the percentage of lot that may be <br />occupied; the size of yards, courts, and other open spaces; the density of population; and the <br />location and use of buildings, structures, and land for trade, industry, residence, or other purposes; <br />and <br /> <br /> WHEREAS, the westerly portion of Downtown Louisville is uniquely characterized by <br />existing lot and building configurations, and by a variety and scale of development that foster <br />pedestrian activity and a rural, historical, and "small town" atmosphere; and <br /> <br /> WHEREAS, for purposes of this ordinance, the "Westerly portion of Downtown Louisville <br />includes those portions of that certain Commercial Community (C-C) zone district, and that certain <br />Commercial Business (C-B) zone district, of the City which are described in Exhibit A, attached <br />hereto and incorporated herein, and which are depicted on that portion of the official zoning map of <br />the City of Louisville that is attached hereto as Exhibit B and incorporated herein; and <br /> <br /> WHEREAS, the unique character of the Westerly Portion of Downtown Louisville should <br />be preserved by ensuring that new construction is not out of scale or character with existing <br />development in such area while providing a balance between the reasonable use of property and <br />maintenance of appropriate scale and character of development; and <br /> <br /> <br />
