Historic Preservation Commission <br />Meeting Minutes <br />21 December 2020 <br />Page 3 of 14 <br />Klemme and Director Zuccaro discussed that there was currently no option to offer grants for <br />residential conservation easements and confirmed that the homeowners were willing to have <br />the City purchase the easement in lieu of a grant. Klemme asked if there was an advantage to <br />the property owner either way and Director Zuccaro replied that there was an advantage to the <br />City in making it a grant because the grant would allow the City to ensure that the money would <br />be spent for preservation costs. <br />Dunlap asked if the massing of the addition was part of why the application was for an <br />easement as opposed to a landmark. <br />Zuccaro confirmed. <br />Klemme asked about the meaning of "not eligible" for landmarking in the case of the Rex <br />Theatre conservation easement. <br />Zuccaro replied that he did not know that the Rex would have been eligible for full landmarking. <br />He observed that because the program was voluntary, a property owner may have an eligible <br />structure but be willing unwilling to landmark it. In the case of 601 Lincoln, the structure was <br />eligible, but it was possible that the proposed addition would cause a loss of eligibility based on <br />Alteration Certificate criteria. <br />Dunlap appreciated that the Extraordinary Circumstances language was becoming an issue and <br />he thought that allowing multiple bids to address questions about cost was a good idea, but he <br />thought that Resolution 31 should be worked on and approved by City Council since it was a <br />major revision. <br />Zuccaro replied that the City Attorney had reviewed the draft language for Resolution 31 and the <br />conservation easement form and he confirmed that both the easement request and the code - <br />related resolution would go through Council. <br />Dunlap asked about the ability to change the front fa9ade in the current language. <br />Zuccaro replied that the property owner was not allowed to make any changes in the first 10 <br />feet under the zoning bonuses with the initial building permit, but that someone could come in <br />later and tear down the facade. He stated that the zoning ordinance may need to be updated <br />and confirmed that a conservation easement purchase would involve a protection on the facade <br />in perpetuity. He suggested that the Commission could approve the easement purchase request <br />and work on the Code changes subsequently. <br />Dunlap stated that there were a lot of overlapping documents at play and he would feel more <br />comfortable considering all of them together. <br />Haley agreed that it was a lot of moving parts that combined zoning and preservation. <br />Zuccaro stated that the Commission could consider continuing both resolutions, though he <br />noted that the applicant had a desired timeline. <br />Andy Johnson, DAJ Design at 922A Main Street, stated that all the mechanisms for this kind of <br />project were in place but they had not been put together and he viewed them as great <br />3 <br />
