WHEREAS, the Louisville Planning Commission, after notice by publication and a <br />public hearing, did not recommend the City Council approve a temporary moratorium as <br />set forth in this ordinance; and <br /> <br /> WHEREAS, City Council has provided notice of a public hearing on said ordinance <br />by publication as provided by law and held a public hearing as provided in said notice. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. The foregoing recitals are hereby affirmed and incorporated herein <br />by this reference as findings of the City Council. <br /> <br /> Section 2. Upon the effective date of this ordinance, and until May 17, 1999, no <br />application for approval of a preliminary PUD development plan, a final PUD development <br />plan, or a special review use shall be reviewed, approved, issued, or otherwise acted <br />upon for any property within Downtown Louisville, as defined herein, unless otherwise <br />provided in this ordinance. <br /> <br /> Section 3. The restrictions contained in this ordinance shall not apply to any <br />application for any facility which is to be publicly owned and operated and is necessary for <br />the public health, safety and welfare, including but not limited to, police, fire, and <br />emergency service facilities. <br /> <br /> Section 4. The restrictions contained in this ordinance also shall not be <br />construed to affect any development or use under a final PUD development plan or <br />special review use which has been finally approved by Resolution of the Louisville City <br />Council and which is in conformance with all conditions and regulations applicable to such <br />approval, or to affect any final PUD development plan for which a complete application <br />has been filed with the Planning Department prior to the effective date of this ordinance. <br /> <br /> Section 5. The provisions of this ordinance are temporary in nature and may be <br />repealed by a subsequent legislative enactment. The temporary moratorium established <br />by this ordinance shall terminate as of May 17, 1999, unless sooner repealed. <br /> Section 6. The City Council herewith finds; determines, and declares that this <br />ordinance is necessary for the immediate preservation of the public health and safety in <br />order to address and mitigate the potential adverse consequences of further development <br />in Downtown Louisville without a concentrated study of the concerns stated herein and <br />the adoption of methods by which such concerns shall be addressed. Therefore, this <br />ordinance shall take effect upon adoption and signing by the Mayor if approved by three- <br />fourths of the members of the City Council. <br /> <br />Section 7. If any portion of this ordinance is held to-be invalid for any reason, <br /> <br /> <br />
