ORDINANCE NO. 1321 SERIES 1999 AN ORDINANCE AMENDING CHAPTER 1.16 OF THE LOUISVILLE MUNICIPAL CODE TO PROVIDE PROCEDURES FOR THE WITHDRAWAL OF INITIATIVE PETITIONS AND REGARDING TITLES FOR INITIATIVES, REFERENDA AND REFERRED MEASURES, AND DECLARING AN EMERGENCY. WHEREAS, pursuant to Article V, Section 1 of the Colorado Constitution, the initiative and referendum powers are reserved to the registered electors of the City as to all local, special, and municipal legislation of every character in or for the City; and WHEREAS, pursuant to Article V, Section 1 of the Colorado Constitution, the manner of exercising such powers shall be prescribed by general laws, except that cities, towns, and municipalities may provide for the manner of exercising such powers as to their municipal legislation; and WHEREAS, pursuant to C.R.S. section 31-11-111, the City Council may, without receipt of an initiative or referendum petition, submit any proposed ordinance or resolution or any question to a vote of the registered electors of the City; and WHEREAS, pursuant to C.R.S. section 31-11-111, ballot titles for initiatives and referenda are to be fixed by the City Council or its designee, and ballot titles for referred measures are to be fixed by the City Council; and WHEREAS, pursuant to C.R.S. section 31-11-111, protests concerning ballot titles for initiatives, referenda and referred measures shall be conducted as provided by local ordinance or resolution; and WHEREAS, the City desires to enact provisions regarding the withdrawal of initiative petitions and regarding ballot titles; WHEREAS, such provisions are intended to clarify the manner in which the rights of initiative and referendum are exercised, and are not intended to diminish or infringe upon the free exercise of such rights. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1.
