ORDINANCE NO. 1321 <br />SERIES 1999 <br /> <br />AN ORDINANCE AMENDING CHAPTER 1.16 OF THE LOUISVILLE <br />MUNICIPAL CODE TO PROVIDE PROCEDURES FOR THE WITHDRAWAL <br />OF INITIATIVE PETITIONS AND REGARDING TITLES FOR INITIATIVES, <br />REFERENDA AND REFERRED MEASURES, AND DECLARING AN <br />EMERGENCY. <br /> <br /> WHEREAS, pursuant to Article V, Section 1 of the Colorado Constitution, the <br />initiative and referendum powers are reserved to the registered electors of the City as to <br />all local, special, and municipal legislation of every character in or for the City; and <br /> <br /> WHEREAS, pursuant to Article V, Section 1 of the Colorado Constitution, the <br />manner of exercising such powers shall be prescribed by general laws, except that cities, <br />towns, and municipalities may provide for the manner of exercising such powers as to <br />their municipal legislation; and <br /> <br /> WHEREAS, pursuant to C.R.S. section 31-11-111, the City Council may, <br />without receipt of an initiative or referendum petition, submit any proposed ordinance or <br />resolution or any question to a vote of the registered electors of the City; and <br /> <br /> WHEREAS, pursuant to C.R.S. section 31-11-111, ballot titles for initiatives and <br />referenda are to be fixed by the City Council or its designee, and ballot titles for referred <br />measures are to be fixed by the City Council; and <br /> <br /> WHEREAS, pursuant to C.R.S. section 31-11-111, protests concerning ballot <br />titles for initiatives, referenda and referred measures shall be conducted as provided by <br />local ordinance or resolution; and <br /> <br /> WHEREAS, the City desires to enact provisions regarding the withdrawal of <br />initiative petitions and regarding ballot titles; <br /> <br /> WHEREAS, such provisions are intended to clarify the manner in which the <br />rights of initiative and referendum are exercised, and are not intended to diminish or <br />infringe upon the free exercise of such rights. <br /> <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF <br />THE CITY OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. Section 1.16.030 of the Louisville Municipal Code is hereby <br />amended to read as follows (words to be added are underlined; words to be deleted are <br />~): <br /> <br />Sec. 1.16.030.
