ORDINANCE NO. 1320 <br />SERIES 1999 <br /> <br />AN EMERGENCY ORDINANCE AUTHORIZING THE PAYMENT OF CITY MONEYS <br />FOR THE ACQUISITION OF VACANT REAL ESTATE FOR PARK PURPOSES <br /> <br /> WHEREAS, the City of Louisville and Robert W. and Carol D. Lathrop have entered into a <br />Purchase Contract for the City's acquisition for park purposes of a parcel of land of approximately <br />10 acres, located at the south end of Main and Front Streets between Roosevelt Avenue and County <br />Road, and more particularly described on Exhibit A, attached hereto and incorporated herein by this <br />reference (hereinafter "the Property"); and <br /> <br /> WHEREAS, the Purchase Contract provides that the City shall pay the owners of the <br />Property a total purchase price of Two Hundred and Twenty Thousand Two Hundred Dollars <br />($220,200.00) for the Property; and <br /> <br /> WHEREAS, the City Council by this ordinance desires to identify the source of funding for <br />such purchase and otherwise comply with Section 31-25-202, Colorado Revised Statutes. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. Unless other funds become available for use by the City as determined by <br />the City Council, moneys from the City Conservation Trust Fund shall be used to pay the purchase <br />price of the ProPerty, which Property is described on Exhibit A and in Purchase Contract therefor. <br /> <br /> Section 2. City payment for the Property shall be made in cash, certified funds or City <br />warrant, subject to the Purchase Contract and to any necessary budgetary transfers or supplementary <br />budgets and appropriations in accordance with State law. <br /> <br /> Section 3. Nothing in this Ordinance is intended to nor should be construed to create <br />any multiple-fiscal year direct or indirect City debt or fiscal obligation whatsoever. <br /> <br /> Section4. The City Council herewith finds, determines, and declares that this <br />Ordinance is necessary for the immediate preservation of the public health and safety in order to <br />effectuate the timely purchase of the Property for park purposes, and that this Ordinance shall take <br />effect upon adoption and signing by the Mayor if approved by three-fourths of the members of the <br />City Council. <br /> <br /> Section 5. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br />that any one part be declared invalid. <br /> <br /> <br />
