City Council <br />Meeting Minutes <br />October 19, 2021 <br />Page 10 of 11 <br />Mayor Stolzmann introduced the item and asked if there are any disclosures; seeing none <br />she opened the public hearing. <br />Deputy City Clerk Genny Kline stated the Colorado General Assembly passed Senate Bill <br />21-082.The bill has changed the rules related the liquor licensing of festivals. Previously, <br />festivals were limited to winery licensees but the bill amends the regulations to include the <br />multiple other license types. The bill allows already licensed establishments to sell or <br />serve alcohol at a festival event (up to nine per year) just as they would in their <br />established premises. <br />The new law requires the applicant to apply with the state for a permit. If the City does not <br />implement parallel local licensing requirements, the state has the ability to grant the <br />permit, with the stipulation that the festival organizer notify the municipality 10 days prior <br />to the event. Staff recommends the creation of a local permitting process that would allow <br />staff and the Local Licensing Authority (LLA) the ability to review the event and place <br />appropriate conditions as needed. <br />The proposed ordinance creates a process for the LLA to review and approve festival <br />permits. It also updates references in the LMC to the appropriate sections and articles of <br />the Colorado Revised Statutes which were moved a few years ago from Title 12 to Title <br />44. The proposed resolution sets the application fee for a festival permit at $150. The fee <br />can be updated annually when Council sets fees. <br />The Louisville Local Licensing Authority reviewed the proposed ordinance and resolution <br />at their September 27, 2021 meeting and recommends approval. <br />= 011 WOTST171u-I 0.1.em <br />Motion: Councilmember Brown moved to approved Ordinance No. 1818; seconded by <br />Mayor Pro Tern Maloney. <br />Public Comments — None <br />Vote: Motion passed by unanimous roll call vote. <br />Motion: Mayor Pro Tern Maloney moved to approved Resolution No. 73; seconded by <br />Councilmember Fahey <br />Vote: Motion passed by unanimous voice vote. <br />UPDATE ON CITY MANAGER RECRUITMENT PROCESS <br />Mayor Pro Tern Maloney gave an update on the City Manager Recruitment Process.
