ORDINANCE NO. 1312 <br />SERIES 1999 <br /> <br />AN ORDINANCE CONCERNING INCREASED PENALTIES FOR MOVING <br /> TRAFFIC VIOLATIONS IN SCHOOL ZONES <br /> <br /> WHEREAS, pursuant to Model Traffic Code Section 1102(4), as adopted with amendments <br />by the City of Louisville, and Louisville Municipal Code Section 10.04.050, the City of Louisville <br />has designated certain safety zones surrounding schools as school zones, with posted reduced <br />maximum speed limits; and <br /> <br /> WHEREAS, the City Council of the City of Louisville finds that school zones are areas that <br />warrant special consideration in terms of traffic regulation and enforcement; and <br /> <br /> WHEREAS, the City Council has determined that increases in the penalties and surcharge <br />for speeding and other moving traffic violations within designated school zones are necessary to <br />promote the safety of school children and will promote compliance by drivers with posted reduced <br />maximum speed limits and other traffic regulations within such zones. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. Section 10.04.020 Of the Louisville Municipal Code is hereby amended by <br />the addition of a new subsection (K) to read as follows: <br /> <br />K. Section 614. School zones - increase in penalties for moving traffic <br /> violations. <br /> <br />(1) <br /> <br />Any person who commits a moving traffic violation in a school zone is <br />subject to increased penalties and surcharges. <br /> <br />(2) <br /> <br />For the purposes of this section, "school zone" means an area that is <br />designated as a school zone and has appropriate signs posted indicating that <br />penalties and surcharges will be doubled. <br /> <br /> (3) This section does not apply if the penalty and surcharge for a violation has <br /> been doubled pursuant to Section 613 because such violation also occurred <br /> within a highway maintenance, repair, or construction zone. <br /> Section 2. If any article, section, paragraph, sentence, clause, o phrase of this ordinance <br />is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or <br />constitutionality of the remaining portions of this ordinance.
