ORDINANCE NO. 1311 <br />SERIES 1999 <br /> <br />AN ORDINANCE OF THE CITY OF LOUISVILLE PROHIBITING SOLICITATION ON <br />OR NEAR PUBLIC STREETS OR HIGHWAYS <br /> <br /> WHEREAS, sales to and solicitation of persons in vehicles traveling on City streets and <br />highways create risks of severe personal injury and property damage; and <br /> <br /> WHEREAS, such sales and solicitation also disrupt traffic patterns and increase traffic <br />hazards and the risk of accidents; and <br /> <br /> WHEREAS, the City Council deems that there is a significant governmental interest in <br />traffic and pedestrian safety, and in assuring the free movement of vehicle traffic on City streets and <br />highways; <br /> <br /> WHEREAS, the City Council finds that prohibiting sales or solicitations from public <br />roadways still affords ample alternative means and channels of communication. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. Chapter 12.20 of the Louisville Municipal Code is hereby amended by the <br />addition of a new Section 12.20.100 to read as follows: <br /> <br />Sec. 12.20.100Solicitation on or near street or highway. <br /> A. The purpose of this section is to prevent dangers to persons and property, <br />to prevent delays, and to avoid interference with the traffic flow. Roadways that have <br />center medians often are designed to deal with specific traffic flow problems. Any <br />delay or distraction may interfere with traffic planning. Sometimes persons stand <br />near intersections and near traffic lights to contact drivers or passengers in cars that <br />are passing or that are stopped temporarily due to traffic lights. <br /> B. It shall be unlawful for any person to solicit employment, business, <br />contributions, or sales of any kind, or collect monies for the same, from the occupant <br />of any vehicle traveling upon any street or highway when such solicitation or <br />collection: <br /> 1. Causes the person performing the activity to enter onto the traveled <br /> portion of a street or highway. <br /> 2. Involves the person performing the activity to be located upon any <br /> median area which separates traffic lanes for vehicular travel in <br /> opposite directions. <br /> 3. The person performing the activity is located such that vehicles <br /> cannot move into a legal parking area to safely conduct the <br /> <br /> <br />
