That would be an extreme circumstance but <br />there were options. <br />Brauneis invited summations. <br />Zuccaro liked Commissioner Hoefner's addition to the natural grade language. <br />Hoefner restated his language, which would be added to Section 17.8.205, as follows: <br />"the elevation of a lot undisturbed by development, or if the lot has already been <br />developed, redevelopment including the addition of fill, berms, retaining wall, and <br />landscape." <br />Brauneis asked if Director Zuccaro was comfortable with that language. <br />Zuccaro confirmed. <br />Hoefner made a motion to approve Resolution 4, Series 2021, with the amendment of <br />language as stated previously by Commissioner Hoefner. Moline seconded. Motion <br />approved unanimously by roll call vote. <br />PLANNING COMMISSION COMMENTS <br />Hoefner requested to add a discussion of the noise and hours downtown to the next <br />agenda that was not too packed. <br />Ritchie stated that the discussion was timely and staff would follow up. <br />Zuccaro stated that the City Council legal committee three years ago studied this issue <br />and looked at a decibel -based noise ordinance for downtown, which had not been <br />moved out of committee. There had been a lot of public comment and staff could bring <br />background on that discussion for a study session. <br />Howe stated that it would be helpful to look at the density of residential areas <br />downtown. <br />Ritchie replied that there were different standards for different areas and it might make <br />sense to do a tiered approach based on context. <br />Williams added that Moxie and Crystal Springs were put in different standards based on <br />being in a transition zone. <br />Zuccaro stated that that was the rationale for Crystal Springs since there hadn't been an <br />opportunity to buffer, but he noted that the Grain Elevator was immediately across the <br />street from residential and they had not had a buffer. <br />STAFF COMMENTS <br />
