Boulder County Clerk, CO ORO R 15,68 <br />ORDINANCE NO. 1309 <br />SERIES 1999 <br /> <br />AN ORDINANCE AMENDING ORDINANCE NO. 501, SERIES 1976, TO ELIMINATE <br />THE GEOLOGIC HAZARD AREA DESIGNATION FOR OUTLOT A OF LOT 5, BLOCK <br />7, THE BUSINESS CENTER AT C.T.C. <br /> <br /> WHEREAS, pursuant to C.R.S. §§24-65.1-101 et seq. ("House Bill 1041"), the City is <br />authorized to designate matters of state interest, including geologic hazard areas; and <br /> <br /> WHEREAS, pursuant to House Bill 1041, the City by Ordinance No. 501, Series 1976, <br />designated the boundaries of certain geologic hazard areas within property in the City and generally <br />known as the Colorado Technological Center CC.T.C."); and <br /> <br /> WHEREAS, such designated areas included an Outlot A on Lots 6 and 7, Block 7, C.T.C. <br />First Filing, which Outlot A is, as the result of a resubdivision, now on Lot 5, Block 7, the Business <br />Center at C.T.C.; and <br /> <br /> WHEREAS, pursuant to House Bill 1041 and Louisville Municipal Code Chapters 17.32 <br />and 17.44, the City has authority to amend the designated boundaries of a geologic hazard area; and <br /> <br /> WHEREAS, the owner of Lot 5, Block 7, the Business Center at C.T.C. has requested the <br />City amend Ordinance No 501, Series 1976, to eliminate the geologic hazard area designation for <br />Outlot A of Lot 5, Block 7, the Business Center at C.T.C. COutlot A"); and <br /> <br /> WHEREAS, the Louisville Planning Commission has held a public heating on the request <br />and has forwarded a recommendation to the City Council; and <br /> <br /> WHEREAS, the City Council has duly considered the Commission's recommendation and <br />has held a public hearing on the request; and <br /> <br /> WHEREAS, at the hearing there was presented evidence in support the owner's request, <br />including evidence that the designation of Outlot A is overbroad and that the appropriate geologic <br />hazard area designations within Lot 5, Block 7, the Business Center at C.T.C. are those <br />designations set forth in Ordinance No. 1307, Series 1999; and <br /> <br /> WHEREAS, the City Council finds that the granting of the request to eliminate the <br />geologic hazard area designation for Outlot A is not contrary to the public health, safety and <br />welfare, and otherwise meets the criteria of House Bill 1041 and the Louisville Municipal Code. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> <br />
