Board of Adjustment <br />Meeting Minutes <br />August 18, 2021 <br />Page 2 of 5 <br />Cooper states that for the requested variance to be approved, four (4) votes will be <br />needed to be affirmative. <br />Hassan verifies the application to be heard this evening is complete, and was mailed to <br />the surrounding property owners on July 30, 2021, published in the Boulder Daily <br />Camera on August 1, 2021, and the property was posted on July 30, 2021. <br />Motion passes unanimously by voice vote that all requirements have been satisfied and <br />the application submitted by the applicant has been properly filed. <br />Cooper asks if anyone at the hearing has any objections to the hearing procedures she <br />described and asks if there were any other preliminary matters that needed to be taken <br />care of. None are heard. <br />Conflict of Interest and Disclosure: <br />Cooper asks for disclosures from the board members for any site visits, ex parte <br />communications, and any conflicts of interest or required disclosures for the application. <br />All Board members indicate they did not have any ex parte communications or any <br />conflicts of interest for the application. <br />Cooper asks the applicant if they are ready to proceed with the hearing. The applicant <br />indicates they are ready to proceed with the hearing. <br />Staff Report of Facts and Issues: <br />Hassan informs the board that this application is a request for a variance from the <br />Residential Estate (R-E) minimum front setback (Centennial Drive) of thirty feet to allow <br />a second -story addition on an existing first -story front setback of twenty-six feet and ten <br />inches. <br />She shows the location by displaying aerial photos and reviews the background history <br />of the property. This property is in the Louisville North First Filing subdivision and was <br />built in 1985. <br />She says that the home appears to meet the underlying zoning standards with the <br />exception of the front setback of 26ft-10in, which is below the minimum 30ft front <br />setback requirement. Records show consistent R-E zoning designation and standards <br />on the property since approval of the subdivision, with no previous variances on file for <br />the front setback encroachment. <br />She mentions that the requested variance would allow the construction of a second <br />story addition on top of the existing one-story home. The southern portion of the <br />addition above the garage encroaches into the 30ft front setback and is proposed at <br />26ft-10in from the front property line at its most constrained point. This results in <br />approximately 47 square feet of the addition encroaching into the front -yard setback <br />area. <br />
