City Council <br />Meeting Minutes <br />December 21, 2021 <br />Page 3 of 12 <br />RECONSIDERATION OF ORDINANCE NO. 1811, SERIES 2021 — REDTAIL RIDGE <br />MASTER PLAN <br />ORDINANCE NO. 1819, SERIES 2021 — AN ORDINANCE REPEALING ORDINANCE <br />NO. 1811, SERIES 2021, AN ORDINANCE APPROVING THE FIRST AMENDMENT TO <br />CONOCOPHILLIPS CAMPUS GENERAL DEVELOPMENT PLAN (REDTAIL RIDGE <br />MASTER PLAN) — 2►,d READING, PUBLIC HEARING (advertised Daily Camera <br />12/12/21) <br />OR <br />RESOLUTION NO. 90, SERIES 2021 — A RESOLUTION REFERRING AN ORDINANCE <br />TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF LOUISVILLE AT A <br />SPECIAL ELECTION TO BE HELD , 2022 <br />Mayor Stolzmann opened the public hearing and asked for disclosures. There were no <br />disclosures. <br />City Attorney Kelly stated that the City Council adopted Ordinance No. 1811, Series 2021, <br />on September 21, 2021. That Ordinance approved with conditions a first amendment to <br />the ConocoPhillips Campus General Development Plan (Redtail Ridge Master Plan). The <br />ordinance has not yet become effective because a referendum petition protesting against <br />the effect of the ordinance was timely filed on October 25, 2021. The City Clerk issued an <br />initial statement of petition sufficiency on October 27, 2021 and a final statement of <br />petition sufficiency on December 7, 2021. <br />Upon the Clerk's issuance of a final determination of petition sufficiency, the statutes <br />require the City Council to "promptly reconsider the ordinance." The statutes further <br />provide that, upon reconsideration, if the ordinance is not repealed, the City Council <br />"shall" submit the ordinance to a vote of the registered electors; whether to repeal the <br />ordinance or refer it to the voters is the matter before the City Council this evening. <br />At the December 7 Council meeting, the Council voted to more forward the ordinance that <br />would repeal Ordinance No. 1811. If approved on second reading this evening the <br />ordinance would become effective thirty days after publication. If this ordinance becomes <br />effective, a draft resolution denying the land use application that was the subject of <br />Ordinance No. 1811 would be prepared for City Council's review. <br />If the City Council does not approve Ordinance 1819 on second reading, the resolution <br />calling a special election to decide Ordinance No. 1811 should be referred to the voters. <br />Public Comments <br />RJ Harrington, 457 East Raintree Court, stated he supports repeal of Ordinance No. 1811 <br />rather than sending this questions to the voters; it would be the less divisive road forward. <br />
