Page: 2 o~' 5 <br /> 18/88/1959 8~: ~P <br /> Boulder ¢ounf,~ Clerk, CO ORO R ~5.88 O 8.88 <br /> <br /> WHEREAS, based on the evidence and testimony at the Public Hearing, the City Council <br />has determined that it is appropriate to designate the additional shaft areas as geologic hazard areas <br />of state interest to be regulated under House Bill 1041 within the City, pursuant to and in <br />consideration of the criteria for designation set forth in House Bill 1041 and in the Model <br />Regulations of the Colorado Land Use Commission; and <br /> <br /> WHEREAS, based on the evidence and testimony at the Public Hearing, the City Council <br />has further determined that such designation is appropriate because there exists an intensity of <br />current and foreseeable development pressures within CTC which warrant the City's regulation of <br />development of and land uses in, around and over mine shaft areas; and <br /> <br /> WHEREAS, the City Council finds that all applicable notice and public hearing <br />requirements have been followed regarding the designation of such geologic hazard areas and the <br />adoption of guidelines and regulations for their administration. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. The foregoing recitals are hereby affirmed and incorporated herein as findings of <br />the City Council. <br /> <br /> Section 2. The City Council acting pursuant to C.R.S. Section 24-65.1-101 et seq. hereby <br />designates as geologic hazards areas of state interest those mine shafts located within Lot 5, Block <br />7, the Business Center at C.T.C. (also identified as Lot 3, the Business Center at C.T.C. Replat A), <br />as identified in that certain Mine Closure Survey Report dated June 1989 (updated August 1989) and <br />prepared by Montgomery-Phillips, Inc. for the Colorado Department of Natural Resources, Division <br />of Mined Land Reclamation (MPI Job. No. 219.004)(the "Report"). Such report is hereby <br />incorporated into and made a part of this Ordinance. The boundaries for such designated areas shall <br />be that area within a radius of fifty (50) feet from the center of the mine shaft locations depicted on <br />such Report. Such areas are depicted on the map attached hereto as Exhibit A, which is hereby <br />incorporated into and made a part of this Ordinance. <br /> <br /> Section 3. The geologic hazard areas designated under this Ordinance may be used for <br />any uses set forth in Louisville Municipal Code Section 17.32.220 to the extent permitted by any <br />final PUD development plan governing such areas. Additionally, the geologic hazard areas <br />designated under this Ordinance may be used for and occupied by impervious paving, stormwater <br />detention and landscaping to the extent permitted by any such final PUD development plan. No <br />other development or use shall be permitted within such areas except upon compliance with the <br />applicable amendment and/or permit and certification requirements, and other guidelines and <br />regulations, set forth in Chapter 17.32 of the Louisville Municipal Code, and with all other <br />applicable ordinances. <br /> <br /> <br />
