City Council <br />Meeting Minutes <br />December 7, 2021 <br />Page 3 of 12 <br />REGULAR BUSINESS <br />RECONSIDERATION OF ORDINANCE NO. 1811, SERIES 2021 — REDTAIL RIDGE <br />MASTER PLAN <br />ORDINANCE NO. 1819, SERIES 2021 — AN ORDINANCE REPEALING ORDINANCE <br />NO. 1811, SERIES 2021, AN ORDINANCE APPROVING THE FIRST AMENDMENT TO <br />CONOCOPHILLIPS CAMPUS GENERAL DEVELOPMENT PLAN (REDTAIL RIDGE <br />MASTER PLAN) — 1ST READING, SET PUBLIC HEARING 12/21/21 <br />OR <br />RESOLUTION NO. 90, SERIES 2021 — A RESOLUTION REFERRING AN ORDINANCE <br />TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF LOUISVILLE AT A <br />SPECIAL ELECTION TO BE HELD , 2022 <br />Mayor Stolzmann introduced the item noting there is a choice to be made this evening. <br />Council can either begin the process to repeal Ordinance No. 1811 or approve the <br />resolution calling a special election. <br />City Attorney Kelly stated Ordinance No. 1811, Series 2021, was approved on September <br />21, 2021. The ordinance approved, with conditions, a First Amendment to the <br />ConocoPhillips Campus General Development Plan (Redtail Ridge Master Plan). The <br />ordinance has not yet become effective because a referendum petition protesting against <br />the effect of the ordinance was timely filed on October 25, 2021. The City Clerk issued an <br />initial statement of petition sufficiency on October 27, 2021 and issued a final <br />determination of petition sufficiency on Tuesday, December 7, 2021. <br />Upon the Clerk's issuance of a final determination of petition sufficiency, the statutes <br />require the City Council to "promptly reconsider the ordinance." Tonight the City Council <br />can determine if it would like to repeal Ordinance No. 1811, Series 2021. To do this would <br />require two readings of a new ordinance. If a new ordinance is approved it would become <br />effective 30 days after publication and then the Council would consider a resolution of <br />denial to the land use application. That would be in early February. <br />Alternatively, the Council can refer Ordinance No. 1811 to a special election. The statutes <br />require the election be held not less than sixty (60) days and not more than one hundred <br />fifty (150) days after the final determination of petition sufficiency. Staff has begun <br />researching processes and vendors and, given the complexities involved and problems <br />vendors are having with supply chain issues, the City Clerk recommends the special <br />election be scheduled for no earlier than April 5. <br />Mayor Stolzmann asked for disclosures.
